Women will soon be allowed to bare more flesh in Chicago establishments that sell liquor, in a move aldermen approved Wednesday to settle a federal lawsuit by a transgender woman.
The ordinance the City Council passed removes reference to gender from the liquor license statutes governing how much flesh can be shown by performers in various Chicago establishments.
So women in those establishments will no longer be required to affix “pasties” or use other latex coverings on their breasts while performing in such places.
Bea Sullivan-Knoff filed the federal lawsuit in 2016 because she said it was discriminatory that she couldn’t appear t0pless without “pasties” covering her nipples as part of her performance art pieces.
She announced late last year that she had reached a tentative settlement with the city in the suit.
During a hearing last month on the proposal, a city lawyer said performers in establishments that aren’t licensed for adult uses would need to make the case that they aren’t baring their flesh for “prurient interests,” and would only be allowed to do so once every 30 days.
Topless-only restaurants will be allowed to apply for liquor licenses under the change. And strip clubs with liquor licenses will be allowed to do away with “pasties” on their performers.
