If anything, I would think that the county attorney should be looking to see if there is some sort of recall or impeachment process to see if further action can be taken. I don't know how that works in Kentucky, though.

Her duties were to grant licenses for legal marriages. There was nothing in her job description that said it was her duty to grant marriage licenses to straight couples.

This is why she is in jail.
