The Minnesota Supreme Court ruled that a person can’t be found guilty of sexually assaulting someone, who is mentally incapacitated due to intoxication, if that person became intoxicated by voluntarily ingesting drugs or alcohol.

Now if they could only revoke the book deals of heroines who told their truth of victimhood.

I'm sure there will be a lot of screaming about this, but if a person isn't responsible for his/her actions after they become willfully intoxicated we need to toss out all D.U.I. laws.

Is this really a political topic? I'd say it's a culture issue that touches on politics.

Preemptive. We all know this more than likely will end up a political discussion.

I agree. I think everything is politicized now. But if we move everything to Politics, it kind of defeats the purpose.

This is already the law in Minnesota. Not sure what the big deal is.

Legislature in Minn. Stat. § 609.341, subd. 7 (2020). The statute provides:
“Mentally incapacitated” means that a person under the influence of alcohol,
a narcotic, anesthetic, or any other substance, administered to that person
without the person’s agreement
, lacks the judgment to give a reasoned
consent to sexual contact or sexual penetration.

This is not a political issue. It's good to see that some people in positions of power don't default to believe all "victims". And this guy seems like he actually got off in the transaction, unlike master criminal Brock Turner.

The Saint George Floyd Autonomous Zone does not recognize this law .

The State chose not to charge Khalil with fifth-degree criminal sexual conduct which criminalizes
nonconsensual sexual contact, a charge both the State and Khalil conceded would cover
the conduct alleged in this case
but which is a gross misdemeanor rather than a felony for
a first offense. See Minn. Stat. § 609.3451 (2020).

Being drunk and "mentally incapacitated" are two different things. I'd except you to be an expert on the latter, having lived with it for so long.

You know being drunk isn't the same as being passed out. Come on.

Are you telling me if you are at a party and a girl is passed out drunk, you're looking at it like a free chance to score? Or if you saw someone fondling her and trying to fuck her, you wouldn't think that guy is a creepy fuck?

And should you have a preference between those two options, you’ll have an easy time picking a winner in FarveFan v. Frank.

I don't think this ruling means what the writer appears to say it means.

It's not like you can just go around dead horsing women.

It's just that a person can't claim rape based on lack of consent due to impariment.

No still means no. It's just that yes means yes, even tomorrow if there is some regret.

Finally a win for white men. We were in a rough stretch, but now that we can screw passed out chicks, maybe we’ll get that big momentum back.

All the attention this case is getting likely means the law that WfR is so fond of is going to be changed to cover what happened here.

I don't know the exact circumstances of these cases. And likely neither do any of the participants. Also, I don't believe that it said she passed out. It said she "blacked out", and apparently you can drive all over the suburbs and go to casinos in that state.

The problem with this is the principle. Women are equal. They can do anything a man can. They are stronger than men in fact. Unless they get really drunk and go home with a guy. Then believe all women. They are damsels. It's on the guy if the girl is drinking.

Big win for SS! The legislature should just pass a law that any women that feels objectified should be allowed to have any man arrested. Believe all women.
