This is already the law in Minnesota. Not sure what the big deal is. Legislature in Minn. Stat. § 609.341, subd. 7 (2020). The statute provides: “Mentally incapacitated” means that a person under the influence of alcohol, a narcotic, anesthetic, or any other substance, administered to that person without the person’s agreement, lacks the judgment to give a reasoned consent to sexual contact or sexual penetration. |

I don't think this ruling means what the writer appears to say it means. It's not like you can just go around dead horsing women. It's just that a person can't claim rape based on lack of consent due to impariment. No still means no. It's just that yes means yes, even tomorrow if there is some regret. |

And likely neither do any of the participants. Also, I don't believe that it said she passed out. It said she "blacked out", and apparently you can drive all over the suburbs and go to casinos in that state. The problem with this is the principle. Women are equal. They can do anything a man can. They are stronger than men in fact. Unless they get really drunk and go home with a guy. Then believe all women. They are damsels. It's on the guy if the girl is drinking. |
