I had to terminate a guy a few months ago who I inherited in a re-organization, for poor performance, & while talking with our VP of HR he asked me if I knew of or had any awareness of any addiction problems with this guy & I said no, but I had never asked him. HR VP told me not to ask because if he did have a problem & tells me, we are then obligated to help him and provide counseling, etc...

True?

Yes. It is true. Back when I worked in a supervisory capacity, the VP of HR told me the same thing.

And the company I'm at now got rid of a guy for drinking on the job. They covered all of their bases and got him treatment...and it didn't take.
