I really don't. I'm paying $39.99 for the chance to win $200. How is that different than betting on a sporting event or entering an online poker tournament? I have a 1/12 chance of winning 5/12th of the money. The payout isn't great but does the fact that the owners are taking a huge amount of the pot make it not gambling?

Predicting the outcome of individuals in a sport is a skill-based challenge, but predicting the outcome of an aggregate of those players is gambling.

I find this subject very interesting since I've been working on a gambling ("contest") site myself and lining up advertisers. From the research I've done the laws are very vague. There are states that are stricter than others. But ultimately, any gambling site is of questionable legality on a federal level. The enforcement seems quite arbitrary and I would suspect that Don Tiny is close to the truth.

I would say it's similar to "legal" marijuana shops in California. I have a friend who went out there to open one. He's making a shitload of dough but he understands that the feds could close the doors at any time in spite of the fact that his operation is ostensibly legal in the state of California.

1. Fantasy and Roto stuff was carved out of the most recent laws passed. Essentially , you can run a contest, as long as the prize is not based on the entries. So you must say the prize is $10,000...even if 2 people join?

Yeah, and I think the online poker operators have attempted to take the position that since poker is a game of skill it doesn't constitute gambling under the new Act. I don't believe the feds are buying that argument though.
