For wrongful termination. Not only should you get your contract money, you should sue for an additional 2 or 3 million. Here's why. What did you say that's wrong? You said she looked live a host doing a porn awards show. Go before a judge and ask why that's a bad thing to say. Because then they'll have to argue that a legal profession is bad. Then they are the prejudiced ones. That argument won't hold up for them. You'll win. |

Why is this so far fetched? It's not. The Julie's of the world, while claiming Mac is sexist for this, is actually putting down the good women of the porn industry. A legal industry. They're just doing a job. She's hating on those women by claiming it's an insult. Ya know what, maybe it's a compliment. That's what a lawyer would say in court. Like I said earlier, if he said she looked like a Doctor, nobody would be mad. What he said is the exact same thing as saying she looked like a Doctor. Mac would win in court. No doubt in my mind. |

Boilermaker Rick wrote: It's all about how the discipline was different with Levine. That's a good point too. It's also about saying a Porn host of an award show is a bad thing to be. When it's not. Cuz it's perfectly legal to be a host of a porn award show. So what was bad about it, Julie? What, you don't like the ladies that bang for money? That's your problem. It's funny that you pick and choose when you want to be a liberal. I'm gonna be the Social Justice Warrior for the porn girls. How about that? |

Caller Bob wrote: One was a direct attack on a African american female, the other was a shared dumb political meme. Wait, so you're saying if she was white it would be comparable? That's stupid. Race had nothing to do with the joke. It absolutely is comparable. It's literally the same thing. Bruce was making fun of Hillary in the joke. Direct attack on her. So if Hillary was black then it's different? That's a stupid thought. Actually, what Bruce did was worse then what Mac did. Like I said, in court, Mac's comment could be argued as a compliment. |

Neither of us are lawyers, but I doubt you could win in court with the "The sexist tweet was about a white woman" defense especially when the much more logical explanation is Mac was expensive to a company who is financially struggling.

What if Mac becomes disgruntled and storms the 670 studio and takes Parkins hostage? That would be more entertaining than a lawsuit |

For a wrongful termination claim to have legs, he must have been discriminated for a prohibited reason- ie sex, race, age, etc. He was terminated for none of those. His termination was directly related to an inappropriate tweet. His only cause of action is breach of contract. If the Score was smart, they either fired him based on a specific violation of his contract or paid him a severance and got a signed release. |

But you had an almost exact same scenario play out like 2 weeks before where an employee wasn’t fired for something arguably worse . How does wrongful termination not cover that ? Does Mr Reinsdorf going to bat for you make that much of a difference ? |

My point is why can they determine it was an inappropriate tweet. That's subjective. Go before a judge and say it was a compliment. Why can't it be considered a compliment? Why? Once again, you can't just say it's not a compliment because it's about porn, you hate porn ladies and you think porn is bad. That's not a good argument. Once again, porn is a legal profession. I don't care what you think about his comment. Doesn't matter what I think about the tweet either. I think if you go before a judge, in a court of law, Mac would win. |

Does Mr Reinsdorf going to bat for you make that much of a difference ? This is one of my areas of expertise because we insure these claims. You can fire someone for any reason except a prohibited reason- which are race, age, national origin etc. They have a reason. Companies choose not to fire people everyday even when their performance is subpar, they are late to work, or they are assholes. That doesn’t mean you can’t fire another person for being late. What you are describing would have legs if Bruce was white and Mac was black. Mac could argue, you didn‘t fire the white guy who did the same thing as me, and I am black. Make sense? |

If he hadn't deleted it, Beardown's point could have legitimacy. I don't think Mac gets paid and a suit would be thrown out quickly. |

Ask yourself one question, why was Mac fired? Is there any question it was because of that Tweet? None of the other stuff matters. Did they fire him because he’s over 40? No. Because he’s a christian? No. Because he’s straight? No. He was fired for a legal reason. It doesn’t matter how they addressed other employees. That would only be evidence in a case where they fired him for a prohibited reason. |

Go to the judge with what Bruce did and ask why the company isn't consistent? Bruce did it a few weeks before Mac. Different actions were taken. |

It is not illegal to fire someone. They could fire Parkins right now. They just can’t do it because he’s Jewish. Again though, the contract is another matter. I am telling you this stuff with 100% certainty. It doesn’t mean he won’t or can’t sue to try to extract a settlement. But they had every right to fire him. The only valid claim would be contractual. I would have to see his contract to know if they had a right under it. |
