Mitch changed the rules. They should get out of the way and let someone younger take their spots. Its going to swing the other way to at some point with Republicans trying to get the old guard out when they have control again.


Realistically every President should get an appointment every two years and they justices should have term limits of 18 years. Though that will never happen.

The Supreme Court is one of the most respected institutions in this country. The justices ask great questions and dig deep into cases. Their verdicts are followed by everyone even when many disagree with them. There was an NPR story a few years back where most verdicts are 9-0 and lots decided with a strong majority like 8-1 or 7-2. There is a lot more consensus than you would think.

I would suggest the more broken part of the system is the Senate like the Robert Bork nomination or lack of consideration for Merrick Garland. Also Congress deferring power to the President, and the increasing trend of executive orders are much more problematic to our governance.

Difficult issues like gun control and abortion are always going to upset half the population. The losing side is going to say we need some fix like term limits. But it would not change the controversial nature of the decision. The current system has worked for the entirety of the Republic. There is no reason to change the Court.

Thanks to the Federalist Society, that's exactly what they are. It would be nice if they were more than that, but they're not. They are there to execute their respective parties' orders. It's the same as the Senate, where Pennsylvanians happily elected a drooling vegetable because he'll do as he's told more amenably than the Republican would do as he were told. Everyone just does as they're told, and increasingly, they're told the same thing anyway.

Liberals really betray their innate monarchism with this Supreme Court stuff. Past getting onto the court in the first place, there was nothing special about Ruth Bader Ginsburg. She became too ill to work, worked anyway, but you could have found hundreds of Jewish women who went to Harvard or Yale, replaced her, and not missed a beat. We don't need a Science King and we don't need a Law Queen.

The divisions on the court are the same as divisions in society. The justices have true philosophical differences in the interpretation of the Constitution. Congress is the most dysfunctional part of our branch system.

The politicization really began with what was done to Bork, didn't it?

The president is entitled to his appointees whether to his cabinet or to the courts. "Advice and consent" doesn't mean bringing in politically motivated liars to smear the nominees nor does it mean that the majority leader should bury a nominee until the next election.

Unless the nominee is a flat out criminal, the president should get consent from the Senate.
