Those involved in the recruitment of others to this business could be in deep legal trouble. They must stop talking immediately, and move quickly to hire talented criminal attorneys. There is particular peril for those with long-standing connection to David Hernandez, as such complex relationships make the claim of “I had no idea” unlikely to be proven to the satisfaction of a reasonable juror.

I don't know if I agree with this. I've worked for private companies in the past where the owners would often supply additional capital as needed when there were downturns in the industry. I never ran a background check on the owner. Does that make me one of the dumbest people on the face of the earth? I don't think so. I think I am for other reasons entirely.

A few differences include - I was never in negotiations to be a "co-owner" and I had a bit more history with the people to feel comfortable that they weren't criminals. But, I didn't at first. At first, I was just an employee getting a check from a privately funded group that could have been robbing banks, I guess, for all I knew. This was before you could do a Pappy's Crappy style internet search however. I would have had to hire some service to do so.

I've worked a few places and I've never heard of an employee running a criminal background check on their prospective employer. I will say that I probably will in the future.

Mr. North said he has another sponsor in place to replace NextStep. He wouldn't disclose the name.

If he has had a replacment sponsor in the wings for a month and the current sponsor is the owner and partner of his primary business that means he knew a month ago that something wasn't right. During that month at least 50 bad checks were kited. Some employees had 4...thats FOUR ....payroll checks bounce. As an officer and executive (and perhaps Director, not sure) of the company his knowledge of problems and attempts to get a backup sponsor would be very interesting for the Feds to probe in answer to the question "What did he know and when did he know it"?

I think he'd be wise to follow Danny's advice and to stop flapping his jaws. Between the admissions in Sheman's pieces, the admissions of no due dili on Roe Conn yesterday and then the CYA crap in the Ted Cox article there is enough out there for anyone to start fishing. I'm sure the Feds will want to talk to the new "sponsor" that's been in the wings for a MONTH.

This gets uglier by the hour.

Bernsie is in his glory right now. He never liked North and his contingent at the Score, and this webbio failure proves that he was right all a long. B and B danced on Murph's grave, and Bernsie was down right gleeful to make fun of North ( of course, not referring to him by name).

Act like gracious winners - after all, bernsie, there's lots that we all can be called out on - like how's that play by play career coming along? Big calls from the networks lately? Which is the first thing a lawyer would advise someone to do. I don't think Dan is over the top; far from it.

Here is something people need to learn. Those nice guys, those people who only say good things about people, who never air beefs publicly, who always treat someone with respect even though they don't deserve it, who are all full of that sugary sweetness, THOSE ARE THE PEOPLE YOU WATCH OUT FOR.

Those people do what happened with this Internet Radio scam, con trusting people. I don't know if North was an active participant or a rube, but just because he has a "nice" persona don't believe he was definately innocent. I would not be surprised if North knew a lot more than people think.

I hope no one who was a victim of this does anything drastic and just learns from this. I hope the victims just become more cynical and ask more questions before jumping into something. No matter where you are in your life, life goes on and things do get better.

The two episodes aren't comparable in my mind. Murph was just a guy who was replaced as radio host and yeah, Terry should have maybe let it go and been a gracious "winner."

The North thing is an ongoing news story about a criminal case with fraud and Ponzi schemes and a guy on the run. Plus North won't shut his yap about this; Murph just went away quietly.

We don't know if the F.B.I. has talked to him....I would hazard a guess they sure as shit have.


I think Dan's point was well-taken that if one, even if not a primary target of an ongoing investigation, keeps making public statements about it, one is almost certain somewhere along the line, to say something or introduce a little contradiction to something previously said, that will arouse the interest of the Feds. They don't mess around with shit like this. However, it seems that just like with the background investigations, North has no one competent advising him on the proper course of action here. Mr "Street" is going to "settle the score" himself and he may be sorry.

I know someone, who had someone running a ponzi scheme through their clearing house, unknown to them. They did several background checks on the guy because the rate of money he was going through money was suspicious, and could never find anything because the guy was never a convicted felon or anything like that. After the guy got caught, every employee who had any dealings with the customer had to go through a deposition. This will happen to North, Be-Be and Spaceball no doubt about it. If they had any wrong doings in the matter, it will be found out. North will also be potentially be named in a class action lawsuit since DH used 275K of the money for CSW.

I do have to say that I don't think North was going out with DH getting people to invest in this 16% bullshit, and probably thought the money was coming from his business, but if you profit in anyway from a ponzi scheme, even if you had no idea where the money came from, you can be added to any type of class action lawsuit.
