Accusing someone of being "a drunk" (maybe not just "drunk"), especially with the insinuation that they are unable to properly conduct their profession because of it, could be defamation per se.

In Brynat's case, yes, I think that would mean he has to prove actual malice--though not damages, I think, just that Dan either knowingly made false statements, or made them with reckless disregard as to whether the statement was actually true.

I was more responding to the general question posed by Dr. Ken as to whether you can sue someone for calling you a drunk.
