Even if nothing ultimately comes of it, don't you think the Mess is suing Dan and Audacy, too? That's why there'd be a gag order on discussing the fish matter itself.

That's why I suspect they aren't going into the event itself. If he isn't, they at least are worried he will.

Hell, if I was an Audacy lawyer I would encourage him to just to help their case.

Yeah you got me right as I edited that in. I'm sure Dan's representation has been well-occupied of late, too, but the big concern would have to be the guy whose family was threatened in an argument.

Because Bernstein has a very good case if this was a "for cause" firing given the fact that Audacy did massive layoffs at almost the exact same time.

The fact that the charity made the first move and fired him before Audacy will make it difficult for Bernstein's case.

It would have no bearing on the case. It's also a civil case and it's going to be hard for Audacy to explain the timing. Every market but Chicago seemed to have layoffs and then suddenly a "for cause" firing in Chicago?

All they have to do is show the Twitter exchange and the quotation marks around for cause disappear because literally no person here who did such a thing on a Twitter account with their workplace listed would keep their job.

Yeah, and I didn't buy a word of it. Just schmaltzy flattery to misdirect from the fact that they're two jamokes from out of town in way over their heads.

It's an unfortunate coincidence that bernstein decided to threaten a family at the same time his employer was implementing mass layoffs.

Come on. Even you know that this was a weak firing.

What difference would gender identity make to a person's job performance as an NBA official? The rules of the game are the same regardless of the gender of the official refereeing the game.

This is the world that Dan Bernstein cheered for.

But when Dan argues that the "threat" was that he was going to tag them on twitter then it becomes a big problem for Audacy.

The first tweet Dan made was to say he would physically fight him and that he knew where he lived. That came before the family threat tweet. Dan's case is so weak that even Audacy wouldn't bother to settle to make it go away.

Its because too few employers are willing to stand in the fire for more than 1 second until it blows over.

Unbelievable.

Do you really believe that was the reason? Then you probably believe Mac got fired for saying a sideline reporter was dressed like she was going to an AVN convention. Both were just excuses to fire someone making more money than they wanted to pay for ratings they weren't thrilled with. In both cases they got to terminate for cause which saved the station money.

Just a couple days before the incident Bernstein was praising a gambling ex-player nobody guest for being on blue sky and not Twitter. Bernstein in his praise of blue sky said "there are no Nazis on it" like Twitter.

I don’t think the layoffs have any bearing.

These days wouldn’t you agree it is HR 101 to not speak about a firing or disciplinary action publicly?

Another layer to the "it couldn't have gone any other way" nature of this. He's originally from Northbrook! but from back in the good old days before it was so Jewish!

He probably wanted a way out but would never walk away from the money and whatever perks are leftover at that job. That job has to suck compared to what it was like 20 years ago. The guests suck, the poser coworkers are no talent producers with mics and the leased cars/sponsor freebees and paid trips are probably all gone. He has gone with the show and go attitude for quite a while now. When is the last time he sounded like he was having any fun at a job that should be fun most of the time. Twitter is just assisted career suicide.

Dan will move to Door County and takeover hosting outdoor wisconsin for pbs when the 80 year old guy doing it retires or dies.

I don't know whether "fun" is the word, but Hail Maryland through Thanksgiving at least seemed to get him fired up about the Bears again. Did the best he could with a replacement-level co-host, at least. I kinda tuned out again after football season, but if I'd known that Dan Bernstein's career would soon end over fish tweets, I probably would have stuck around.
