On today’s show, the boys will talk about the rape culture at the University of Tennessee. Dan will talk very s l o w l y and also use several Latin legal terms, so you know he’s serious. I think it’s a safe bet that the Score’s rape expert will also make an appearance at some point. READ THE TESTIMONY! THE TESTIMONY!!! Also, the Cubs have traded Chris Coghlan for Aaron Brooks. I guess Theo wanted to beef up the bullpen by adding a midget shooting guard who can’t shoot. On a positive note, my Score guy has told me Terry will also speak today at some point. Oh and the Bulls are bad. END |

Terry is off to a good start this week. Hasn't had to say a word. Dan states that he's not a doctor, then expounds on the Zika virus for an hour. Dan states that he's not a lawyer, then goes on for an hour on Title IX lawsuits. Mmmm, hmmmm. My guy agrees. |

I tuned in yesterday on the way home, about 5:50 or so, and Terry was saying how he had heard all sorts of stuff about Butch Jones going back to his days at the University of Miami and University of North Carolina. Dan was like "Miami? Uh..." and then the must have Googled Butch Jones and started listing places he previously coached, like Central Michigan and Cincinnati. Terry stumbled over himself for several seconds and then said "Oh, I was thinking of Butch Davis..." |

At least he admitted it. that was pretty bad by Terry yesterday... because he was pretending to know that he was some kind of expert on this tenn. coach's history.... while reciting what butch davis had been doing recently... he referred to multiple times as if phillip fullmer was fired and this davis guy was the replacement... when i think the most casual college football observer would remember the lane kiffin spectacular 1 year then firing at tennesee... of course tery didnt recall that. |

Does anyone want to give me the super-tl;dr version of this Tennessee deal? Objectively, please. I just don't want to actively search out depositions and paperwork and garbage like that to get halfway into it and remind myself that I should've spent that time tying a proper noose. |

As I understand the lawsuit, Plaintiffs allege that Tennessee has showcased a "deliberate indifference" to allegations of sexual harassment/assault/rape on campus, particularly as it pertains to same allegations against the school's athletes, in violation of the school's mandate under Title IX (Title IX making illegal any discrimination based on sex in US-funded education institutions, later expanded by the US Dept of Education to include sexual harassment and violence as discriminatory). I haven't read the specific allegations pertaining to the Plaintiffs, all I've seen are bits and pieces from the complaint that make reference to other allegations of sexual harassment/assault/violence like the Peyton Manning thing, the Marlin Laine-Geraldo Orta rape allegations, etc. These references are made to, I guess, establish a pattern of indifference on the part of the University (all of those investigations fizzled out, the implication being that the fizzling was nefarious), and when coupled with the specific complaints of the Plaintiffs, should substantiate a violation of Title IX, and whatever remedy that would entail. I don't know the standard of evidence, though I'm sure this is a civil matter...maybe? But what constitutes a violation of the Federal law called "Title IX" seems to be more the result of an amorphous collection of facts rather than one single act. IANAL, but I suppose a relevant comp to a complaint regarding Title IX would be trying to argue that there existed an implied contract, or contract implied in law? |

I particularly enjoyed him trying to repeatedly question Tennessee's decision to fire Phil Fulmer and hire Butch Jones. Clearly, quite oblivious to the fact that Fulmer was fired about 8 years ago and there were a few coaches in between him and Jones. |
