Wrong! You can be required to contribute to the kid's college expenses after they turn 18 or graduate high school. When that happens it's not based on a percentage of your net income like normal child support.

You can possibly sneak out the back door and avoid 513 if you reserve the issue of college expenses. 513 essentially says you each agree to contribute to college once the kid is old enough. If you reserve the issue of college you haven't agreed to contribute anything until you are brought back to court on that issue.

If your kid is halfway through college and you've reserved the issue of contribution your ex can't get you to pay for expenses that have already been incurred. Under 513 you can be required to do so.

A bunch of guys I know who gave their early life to the street won't work because of child support. Had a bunch of kids along the way and going legit would require a check on their income.

Having a lot of kids compounded the problem and basically ensured that their lives would be based on some form of hustle.

It's never going to happen because correcting the "problem" would take up an insane amount of judicial resources that are better spent elsewhere.

If there was a way to enforce the "proper" spending of child support every single disgruntled obligor would bring their ex into court each month to make sure the support was being spent "the right way".

Dude was a total deadbeat. After 10 years they found him. This was straight child support. He had to pay principle plus interest (it's steep fellers. Pay in a timely manner). The interest kicked in recently, and the state is issuing the 1099-INT. The family does not believe that was the case prior to now, but who knows. Feds came after her for tax on the child support for 2015. I believe she must pay tax on the interest even though it is because the deadbeat did not pay in a timely manner.

I'm pretty sure the interest is taxable, but if it's child support, even paid in a lump, the past due amounts shouldn't be taxable.

I can understand why the interest might be taxable because it's a surplus. Except that suplus only accrued because of non-taxable support that should have been paid on time but wasnt.

Lots of good info here...the Marital Settlement Agreement (MSA) is a negotiated document....even with the statute on percentages. How and when child support ends is open and very important.

I have 2 kids. I pay 28% child support even though I have joint custody. Because I was in idiot....1) I married her 2) I had kids with her 3) I allowed her to be a "stay-at-home Mom". Because of #3, i also got stuck paying "Maintenance" (formerly known as "alimony") on top of the child support. This resulted in her getting 46% of my net income. It's not right, but I also know there's no shortage of deadbeats that caused this to be the law.

First thing I did after the divorce was final was leave my job of 13 years where I made decent money and find one that paid more. Did not change the amount she received, as long as I was paying her a minimum of 28% of my net income. She now is at about 33% of my net.

I have zero say in how she spends this money....and this is unfortunate, but as Spiral mentioned...no way to enforce and would be a waste of the court's time. I look at is a sunk cost and try not to think about it and just take care of my kids. All extra-curriculars are supposed to be split 50/50. The amount is supposed to cover clothes and stuff they need. Reality is, I pay for 100% of extra-curriculars (including $5K a year on hockey) and arguably buy more than half of their clothing. I could make a stink about it but it's more important for me to take care of my kids and since I have boys, I want them to see the example of a Father being the active provider. My oldest is now 16 and looking at colleges. That will also be likely 100% my problem. The good side is he's now old enough and aware enough to see how lazy and complacent his mother is.

My MSA is hard on me up front, but I win in the end. I have a firm end of child support specified by date on their 18th birthdays and a firm end of Maintenance. If she wanted more money, she'd have to retain and pay an attorney to and likely get nothing. She had her 5 years to find a way to raise her earning potential.

Divorce / Child support sucks...that's just the way it is. Regarding the initial question..one kid is 20% and regardless of how much money you make or how much the kid "needs"...that's what the mother gets.

So yes, GD.....I know all of this all too well!

There's no statute on Maintenance but the general rule of thumb in Illinois is 1/3 of years of marriage. The more years of marriage, the harder it is to get the end date.

I think I mentioned this here before but, in a good dozen or so years I was in and out of that unfortunate court, the most bizarre thing I saw was the giant Alonzo Spellman getting very small and looking very afraid of the mother of his child. The woman was a stunningly hot Asian woman who came to court in all black (leather?) in 4 inch heels that had her standing all of about 5'4".

Two weeks later he was walking away from Halas Hall having a breakdown.

Thankfully she didn't bring her child to court as so many of the sad people did(do?) out of spite.

There IS a statue on maintenance in Illinois. In fact it recently underwent a huge overhaul a few years ago. At the end of the day thought, at least when you're talking about maintenance, whether or not you're going to be required to pay it depends largely upon what judge has your case. Unless of course youve been married for twenty years and your wife never worked. In that case you're fucked.
