Gorsuch can't comment on the constitutionality of the treatment of the candidate before him getting stiffed, when he's up for the Supreme Court?? That's exactly what he would be doing, ruling on constitutional cases!!!
Cases which have been litigated on a set of facts. There is no such case or complaint brought by the cadidate before him.

The guy is literally on a job interview, and one group of management reps is busting his balls about how another group of management reps treated the last guy to interview. And you can cling to that truck case until your fingers turn white, but it's not going to change the fact that all he did was advocate refusal to coax special or unordinary meanings out of the text of law because the facts of a case tug at our emotions...IN A DISSENT, YOU TOOL.
The law prohibiting firing an at will employee for refusal to operate a vehicle they believe to be unsafe hinges on the term "operate", which in its ordinary meaning does not include simply "sit inside of". In order to come to the conclusion that the company unlawfully terminated his employment, we would have to arbitrarily expand the meaning of the term "operate".
