My first inclination is no, probably not (I mean, anyone can sue anyone for anything, whether it would survive a motion to dismiss or a hearing is another question).

Interestingly, though, awhile back I wanted to look at whether it was defamatory to allege racism or prejudice, and on the whole it appears it isn't. There was one very interesting case, though, where someone sued for defamation in the face of allegations of antisemitism (pay attention, LTG), and, as I recall, "won" when the court ruled that a resident telling an assembled HOA that "I know these people, they hate jews" was a false statement of fact and rose to the level of defamation. I say "won" because my hazy memory has me thinking the court said they failed to show damages, blah blah blah.



So calling someone a racist is a matter of opinion and not defamatory because opinions are protected by the First. Saying there is a factual basis to support racism where none actually exists, though....is, or could be, actionable.

There are many that are claiming his eye roll gif is proof that he is a racist and his history has proven it was more than just a simple mistake and there was some sort of ulterior motive to it.

However, if you claim that no one here is saying he is a racist then I'll accept that and I'm sure he will too. I don't think anyone is claiming that his eye roll is proof of him being racist. As I pointed out earlier in this thread the opinion people have of a poster MANY times will cause them to receive things a particular way. Right or wrong the opinion people have is based on his posting history not on 1 post.

As for the Mueller case, There are a few people here who are aware of some of my personal contacts within the legal community in DC. And they are quite extensive. I found a lot of your suppositions about Mueller to be silly rather than anything else.

I just want the actual case to be made. It seems like we are close to the point where it just becomes accepted fact by many that JLN is racist as the eye roll gif is constantly mentioned.

My guess is that it was defended Trump + overlove of cops and legal system + eye roll gif = racist. Just wondering if I missed something.

The Wisemen took a few simple steps to limit racially directed responses when we took over the board. And until recently, they have worked EXTREMELY well. And Management's post was not directed at any previous offenders either.
