I'm joking about it because this kid is pretty close to the arbitrary statutory distinction between "unable to consent" and "able to consent", and in these cases I tend to think it likely the kid was actually able to consent, just like a female 17 year old would be.

So any teacher should be allowed to have sex with 17 and 18 year old students as long as it is consensual?

If the student is above the age of consent, I don't think the teacher should go to jail for it. I would be fine with them losing their job and never being able to teach again.

I agree. I don't think what she did should be viewed as a criminal offense, but rather as a simple breach of trust in the workplace.

It's not hard for an adult to avoid a child until they are 18 though. Why can't we just accept that they should not get involved with them until 18?

I think we do generally accept it, but it is clearly arbitrary as the age of consent varies from state to state. I don't see the justice in a guy going to jail and having to register as a sex offender because he bagged his 17 year old girlfriend in the wrong state.

The issue is the roles of the parties this case rather than their respective ages.

You can accept that. But why cloud this case with the issue? Age of consent issues pertaining to sex crimes in Texas states the victim must be under 17. So it really is only a workplace or teacher-student matter here. Regardless of whether we agree with it or not it seems she is properly charged.

From what I understand, she would be facing no charges if she had waited until 18. That makes it relevant.
