Post subject: | Jury duty |
Is that shit mandatory? Got something in the mail saying that I'm an alternate for jury duty. Notice says that I wouldn't know if I was actually selected until the day before trial. Problem is that I was planning to leave town the day of the trial. What is the penalty for failing to serve jury duty? First time I have ever been selected for this Bullshit. |

If this is real call and say you'll be out of town. My dad worked out if countrt for years and had to do it a half dozen times. It's hard for me to believe you haven't been called. I think I was called 4 times before turning 25. Two of those times I was out of state so i called and that was that. Federal might be a different story. I've been called 5 times out here in boonies but there is never a trial so I just call and get told not to bother on that day. Advantage/disadvantage of small county living. |

Been called several times over the years. Most of them never happened because of the night before call in to confirm no cases before the docket. Thus all jurors were excused. However, a few times I filled out the form stating I had previous travel/vacation obligations with paid deposits, etc. Other written excuses included caring for an elderly relative, work schedule that involved overnights and it was difficult to stay awake during the day, busy time at work, etc. Not every "excuse" works but if you really want to get out of it you will get creative. It worked a couple of times. Two times that I actually had to show up and go through the jury pool - I got out of it both times. One, I went to high school with the defendant and knew him and all of his brothers. The last one and best of all that works every time is the "I'm sorry, sir... can you please repeat the question? I am having difficulty hearing you." You have to rephrase this question several times and turn your head as to point the "good ear" at the judge or attorney questioning you. If questioned about your hearing, you just reply; "Friends and family were getting concerned and said that I should get it checked... I guess they are correct, your Honor. I apologize to the court." You need to go all out Joe Paterno and 99 times out of a hundred you are excused. There are so many retired people around here who are active, sharp and attentive. They are always looking for something to do and this is perfect. They can serve on the jury and I'll take my turn when my retirement calls. |

Only had to serve once. A guy was suing a lady for a car accident, saying he had hurt his back and I forget what he was suing for but multiple hundreds of thousands. He goes to testify and makes this big ordeal of sitting down in the witness stand, lots of groaning and grunting. Lawyers question him, then he is dismissed back to the plantiff's table. Sits down there fresh as a daisy. Took the whole day. |

As much as I hate the concept of jury duty, I wouldn't mind sitting on it because I'm the asshole who believes in Jury Nullification. If the law is bullshit, then I'm voting not-guilty, even if the guy clearly did it as it is my duty to nullify bullshit laws (such as our drug laws) |

Other than the nicotine fits, I actually 'enjoyed' it, as much as one can enjoy such a thing. In around 8am, didn't get home until about 9pm. Went home, fired up 12 Angry Men, and smoked about an entire pack. ![]() |

If it's a car crash injury case, make disparaging comments about chiropractors and "thermal" treatment. Of course the next time I got called I made expressly angry remarks about med malpractice and I still got stuck for a week. After we handed down a really fat (but honest) damage award, insurance defense lawyers probably took notice. Plus if you just can't be there, you'll just get a followup jury summons. But it may be in Rolling Meadows or Skokie...or Bridgeview |

I've only made it to the box once and it was some assault at a movie theatre. Along with the typical do you know defendant or alleged victim or any of the lawyers I was asked of I had seen Rob Roy. Answered no to all questions and was thanked for my service and dismissed. It was first time I was ever called and I assume I was either dismissed because I was fidgety or because I was 21. Heck, I might have been 20 as when I turned 21my new liscence was in Lake County instead of Kane. |

Yeah, but the random selection is kind of the crux of the biscuit in trying to assemble a fair jury. You can't just narrow the pool down to a self-selecting group of "law enthusiasts" who repeatedly volunteer to serve on juries or you're very well turning over a big part of the judicial system to the wrong hands. Just ask yourself: how do you think volunteer-only juries would play out in the Deep South? Probably the same way jury nullification did. Jury duty and draft registration is a screaming false equivalency. |
