My daughter was driving home from college Friday afternoon and got pulled over. It is her first ticket. She was passing a couple of semi trucks on a 4 lane high way and was going down hill. They clocked her at 26 over the limit. I have always told her to not sit next to semi trucks, but to get over and get around them as fast as possible. I did not mean 26 over fast...but I guess she took me pretty literal. The ticket she got does not have an amount. She is scheduled to appear in court in November. The officer told her she would get either a ticket or community service at the court date. Should we hire a lawyer for this or just deal with it ourselves?

Google what she is charged with in your state/county to see what she is facing as punishment. They can't just make it up.

You would likely pay much more for a lawyer than that ticket.

I was concerned about points on her license and insurance going way up. If a lawyer could keep that from happening it would be worth paying more to him one time.

I can find fines up to 25 over limit. Over 25 just says court appearance.

Just show up to court. They will probably drop the charges down to under 25 or clear it if the cop doesn't show. Get Jules to represent her!!!

She should be eligible for court supervision. If she doesn't get another moving violation for six months or something it goes off her record.

She's guilty, just take the plea deal which will be a court supe deal.

26 over in Illinois is a misdemeanor.

She needs to hire an attorney since this is a criminal case. If her record is good they will most likely amend to a petty (non criminal) case and give her supervision which will not go on her record or affect her insurance rates. Insurance companies do not find out about supervisions. My fee is $500 for this type of case.

 I've never hired a lawyer for a speeder. $500 for a lawyer? Chances are she gets traffic school and nothing on her record.

Have your daughter tell the judge that she was racing to home to help her friend who is trying to become a banker.

It's a speeding ticket. She'll pay a fine. 26 over is a good amount (not sure how Illinois works) but the worst is traffic school.

So glad our daughter chose to stay at school this weekend, she and some other friends went to a MN state park/waterfall/swimming hole. We warned her as we left from dropping her at college about her lead foot- I may have a slight amount of pull here in MI with po-po, but absolutely none over there or in between, so she owns it!

Go to court and see what they offer. If you don't like the offer you can ask for a continuance to get a lawyer.

Here is some advice: Last time I went to traffic Court,I found out you can't charge the fine. Bring a checkbook, unless they have changed their rules on payment.

Will your insurance go up by more than the lawyer's fee and fine?

I don't know if this is still the scene there but i have an anecdote to share.

I got a ticket back in the early 90s. Forgot what it was for but traffic violation and I showed up at court on the assigned date.

While I was in the lobby waiting for the court doors to open, there were like so many guys in suits in the waiting area. I came to later realize these were all lawyers.

One of these came up to me and asked me what I was here for. I told him traffic ticket. He said he can represent me for $100 and I'd be out in 30 minutes. I only had like $40 in my pocket and told him I only got $40. He took it.

Court started, the judge asked for everyone who was represented by a lawyer first. The guy i hired for $40 said what he had to say, judge dismissed the ticket, and I was out of there in 30 min.

I dont know if lawyers are still allowed to hang around like then but maybe you can take a chance and hire someone cheap.

They don't do driving school in Missouri to get the ticket off of your record?

   at 500 for a speeding ticket. The dad of one of my former athletes represented me for 75 dollars once and got the ticket thrown out with no traffic school
