Post subject:  Illinois Highway Merging Law ??

Looks like Illinois law on merging was changed last year? Back in the day we learned the person on the highway has to yield right of way to merging traffic unless sign says otherwise. (Still says that in IL Rules of the Road book they hand out).

Now BOTH have to adjust? Must be some kind of insurance company scam of some sort.


(625 ILCS 5/11-901) (from Ch. 95 1/2, par. 11-901)
Sec. 11-901. Vehicles approaching or entering intersection.
(a) When 2 vehicles approach or enter an intersection from different roadways at approximately the same time, the driver of the vehicle on the left must yield the right-of-way to the vehicle on the right.

(625 ILCS 5/11-905) (from Ch. 95 1/2, par. 11-905)
Sec. 11-905. Merging traffic. Notwithstanding the right-of-way provision in Section 11-901 of this Act, at an intersection where traffic lanes are provided for merging traffic the driver of each vehicle on the converging roadways is required to adjust his vehicular speed and lateral position so as to avoid a collision with another vehicle.

I don't read either of those as applying to merging onto a highway.

you might want to have the state change its rules of the road book: pg 70

Merging Lanes
This sign tells a driver that two lanes of traffic going the same di- rection will soon merge into one lane. Drivers should be ready to ei- ther change lanes or allow other traffic to merge into their lane. Merge signs may appear on expressways just before expressway ramps. The driver on the expressway should slow down to let the driver on the ramp merge.

I don't recall this either... The "on the right" rule applies to two cars reaching a all-way stop sign intersection at the same time...never heard anything regarding on-ramp merging traffic taking priority over highway traffic. Both cars are responsible for creating the safest merge scenario possible. And usually that means the car looking to get on the highway doing most of the adjusting, since cars unexpectedly accelerating or decelerating on the highway is what causes most accidents.

It's not right.

You never yield when you have the right of way. That is the fastest way to get someone killed.

and that 24" white stripe...it's called a stop bar. stop before the bar, not put your rear axle over it. and quit trying to make a left turn from a side street to an arterial when i'm in a fucking left turn lane trying to turn to the said side street. You do not have the right of way.

Also can we talk about parking lots? The circulation lanes rule, the drive lanes do not. Me parking is more important than you leaving. It's elevator opposite.

jesus fucking christ people, I quoted you the laws and the rules of the road. explain it to me. show me the law that says who has the right of way for a highway entrance ramp.

that law came into effect Aug 2017 apparently. Just thought you might want to know. IL should probably update its Rules of the Road manual to reflect that.

Kind of along these lines, after merging, the most confused law is who has the right of way to turn right or left from opposite directions. I've had people yell at me for making a left turn in front of them as they were making a right. The law actually states whoever enters the intersection first has the right of way.

Per Road and Track...
Most states place the responsibility of merging solely on the traffic in the lane that is ending. Illinois is one of the few exceptions, and only with regards to freeway on-ramps, where the law of that state places a mutual responsibility on traffic in both lanes to adjust accordingly.

I learned what I quoted from the Rules of the Road book above. Which STILL states....

Merge signs may appear on expressways just before expressway ramps. The driver on the expressway should slow down to let the driver on the ramp merge.
