I think the judge will take it easy on her. If I read correctly the judge allowed her to use the castle doctrine as a defense in another man's house. No more than 10 years is my guess.

Seriously this guy was probably high as hell eating his bowl of ice cream and then some crazy lady bursts into his apartment and shoots him. She blew his high before he passed away. That's fucked up.

I thought the jury may find her defense plausible. She was tired and was on the wrong floor and she was a woman. Then I read last night that the judge allowed the castle doctrine to be used as a defense.

As a juror, it seems like the only difference would have been manslaughter vs murder. I'm not necessarily sure she planned out and had premeditated to kill the guy, but there is no way to have found her innocent.

Manslaughter might apply if she had pulled her gun and aimed it, say, at a passing gaggle of geese flying by behind Jean with the intention of firing a warning shot or securing a Christmas goose or whatever and accidentally shot dude instead. Or if she pulled her gun but didn't intend to shoot and the gun accidentally went off cuz of nerves, then maybe manslaughter. But by her own statement to police she thought Botham was an intruder--so she drew her gun, aimed directly at Botham Jean, intentionally pulled the trigger and hit her target, rendering the human unlive. That's murder all day, every day, even in Texas.

That's kinda what I thought too. Maybe there was something more to it that we haven't heard. Either way before pulling the trigger she should have been able to recognize that she was in the wrong apartment and the man high as hell and eating ice cream on the couch wasn't a threat. They had enough time to yell at each other.

I haven't followed the story since it happened, but are we sure she went into the "wrong apartment"? I remember reading she had previous beef with the guy.

If they never knew each other it's pretty tough to create a motive. It seems like her story added up especially when combined with her 911 call. It's a terrible tragedy, and she likely never should have been a cop or given a gun in the first place.
