If im salary, exempt, and they dont pay overtime... Can they dock money for working less than 40 hours? Dont think so, but then i see theres a classification of salary non exempt, whatever bullshit that is. I will know next week im leaving early every day this week out of spite. If im short a dime ill quit and will need a job does anyone need help |

There is a legal minimum salary where companies still have to pay overtime. Think of a person running a McDonald's restaurant that works 80 hours per week but is paid like $30k. I suspect that is what they mean by salary non exempt (exempt being from wage andf hour laws). That threshold is just above $35k now. https://www.natlawreview.com/article/dol-final-rule-changing-salary-threshold-exempt-white-collar-employees-to-take-0 Normally if you are salary exempt, you get paid regardless of how many hours you work. I actually do not know if they can legally pay you less if you work less than 40 hours. I am not aware of anything to prevent that from happening, but it seems shady since they cap you if you work more than 40. As for working on my estate, I can handle my two acres well enough on my own. lol |

As for working on my estate, I can handle my two acres well enough on my own. lol i work in payroll and this is correct. the only situation where a salary exempt employee is going to receive "less" than their salary, (even though it really isnt) is if you say are set to receive a salary of 80 hours each payroll and you take 8 hours vacation. Most companies have the paid time off code set up to reduce the salary to be 72 hours and 8 hours PTO in this situation. You receive your full salary, but the hours are reduced to account and keep it at the full payroll as opposed to 80 hours + 8 additional. |

Illinois State rules: Illinois' Overtime Minimum Wage Overtime pay, also called "time and a half pay", is one and a half times an employee's normal hourly wage. Therefore, Illinois' overtime minimum wage is $18.00 per hour, one and a half times the regular Illinois minimum wage of $12.00 per hour. If you earn more then the Illinois minimum wage rate, you are entitled to at least 1.5 times your regular hourly wage for all overtime worked. Certain employees must be paid overtime, at time and one-half of the regular rate, after 40 hours of work in a workweek. Fucking Union squeezing in my line of trade is grown frustrating. |

My last job was salary exempt, but they did stipulate you have to be on site 1 hour in a given day to qualify for a full days pay. Not even sure if thats legal, but these days whos enforcing it? |

Either you use an 8 hour PTO day off or you don't, no partial docking (heh-heh) among exempts. (or whatever your work day is, 7.5 is popular nowadays). At the end of the day, if you're a valued employee who gets the job done, you can probably do what you like. If you're a lackluster employee no one would miss, NBC. |
