Post subject:  Chicago Area Lawyers

I feel bad for my son. He was driving his truck and the woman that was responsible got a ticket or at least responsibility on an accident report. Turns out after months the mickey mouse insurance card she provided (Chicago First Ins or something) was not really valid the date of the incident.

This is likely too small for any attorney to take up as the ambulance chasers want a bigger pie to take their cut from. Do any of you know of recourse methods in Chicago burbs for this crap? Like small claims court for auto.

The small claims limit in Illinois is $10,000, so if his damages are under that he can take her to small claims.

Mike it is easier than that. His insurance should have under insured/ uninsured auto coverage. His carrier will cover his losses and subrogate against the woman (if they choose to).

Please use his insurance company. It happens all the time, and it is why you should have that coverage on your policy.

Yes thanks I did know that. He is so worried they would raise his premiums again. He has no claims with his current company State Farm but had a couple in the recent past.

It's never worth worrying about the premiums being raised especially with State Farm. They'll continue to raise your rates either way.

It's also really easy to switch insurance now and an accident not caused by him isn't going to raise any rates.

He needs to consider that a judgment isn't an order for her to pay him. It's just a piece of paper that says party "A" owes party "B" a certain amount of money. It's up to him to collect it. A lot of people are judgement proof and simply don't have any money to pay.
