Common sense prevails. The guy he shot shouldn't of been on the street in the first place.

Prosecutors Monday dropped weapons charges against an 81-year-old Englewood man who shot a teen who police said had broken into his home.

Homer Wright had been charged with unlawful use of a weapon because as a felon he is not allowed to have a gun.

Court records showed Wright pleaded guilty to a 1990 theft charge and served two years on probation, and then served another 2-1/2 years on probation for a 1994 charge of unlawful use of a weapon.

He declined to talk to a reporter after a Monday morning court hearing.

Anthony Robinson, 19, was trying to break into Wright’s home in the 6400 block of South Morgan Street to steal liquor about 6:30 a.m. March 26 when Wright shot him in the ankle, authorities said.

Robinson, of the 6600 block of South Wood, was charged with burglary.

After Wright was charged, family and neighbors rallied around Wright, who they said has run Sheree’s Past Time tavern in the front of his home and lived in the back with his wife and family for more than 40 years.

His grandson said the building had been targeted several times by burglars in the last year or so.

“You see, when you’re breaking into peoples’ places and you’re not supposed to be there, you’re supposed to do what you have to do, and that’s what I did,” Wright told NBC5 on Tuesday.

“I think it’s wrong and it’s unjust that I can’t protect me and my whatever, and that’s wrong.”

Court records show Robinson has been arrested at least 13 times since 2009, mostly on theft, burglary and minor drug charges. Records also show he skipped multiple hearings. He was being held on $150,000 bail.

I think they should both be in jail if we're going to respect the law, shouldn't they? Wasn't the old guy just the same as the young guy twenty years ago? And even after his sentence and probation he still has total disrespect for the law and gets himself an illegal firearm that he isn't supposed to have.

How many felonies til we REALLY dont want them having guns?

The gun charge from 20 years ago was likely because he was convicted of a felony in the 60's. He can sell liquor but can't use a gun that may or not be his to protect his business. He was nice enough not to kill the kid.

I'm sure the gun is confiscated. So...as long as he doesn't drive a car ANYWHERE, I'm o.k. with this one.

Nas if he had killed the kid, old man goes to prison.

Tough call on the prison, but I would probably have to say yes.

I know it's the law but what are you supposed to do? Someone breaks into your home and your spouse has a gun but you'll go to jail if you use it. What would be a lawful use of a weapon in a potential life or death situation? I don't think the age should matter.

I thought I read he was picked up for burglary in 1990 and 1994

I guess I don't get why anyone sees him as so different than the kid that broke in his house. I'm just asking the question: Should that kid lose his right to have a gun?

McDonald v Chicago. The scotus struck that unconstitutional law down a while back.
