A woman who was arrested for driving under the influence in Riverside allegedly told police she had been drinking because she was celebrating getting her driver’s license back from another DUI.

Erin James’ blood alcohol level was .155--nearly twice the legal limit of .08--after she was stopped for speeding in the 3400 block of South Harlem Avenue shortly after 2 a.m. Friday, police said.

James, 58, failed multiple field sobriety tests and a check of her driver’s license showed that her license was currently suspended from a 2012 DUI arrest in North Riverside, police said.

“James was supposed to be operating a vehicle with a breath alcohol ignition interlock device (BAIID) which would have prevented her from driving intoxicated,” Riverside Police Chief Tom Weitzel said. “The fact that she was driving a vehicle not equipped with a BAIID shows that she had every intent of drinking and getting behind the wheel. Ms. James purposely drove a car that she did not own to avoid the ignition lock device and was driving back from a Forest Park bar where she was celebrating that fact that she would finally have her driving privileges back after her 2012 conviction for DUI. Ms. James is exactly the type of motorist I want kept off the road permanently under a new proposed habitual DUI law that I will be proposing in the very near future.”

Weitzel’s proposal will include loss of driving privileges for 10 years, confiscation of vehicle and a mandatory seven year sentence upon conviction for repeat offenders, police said.

James, of Brookfield, is expected to appear in bond court Saturday for felony aggravated driving under the influence of alcohol.

How far back to they go to check for DUI's? I don't plan on getting one anytime soon but I had one in 1990 and I've wondered if it would still be used against me.

The law is designed to address people with multiple DUI's. If you only had a single DUI, even if it was in past couple years, you wouldn't be in the crosshairs. I had arrested a guy years ago 3 times for DUI in a 9 month period. Thats the kind of guy they are looking for. How was it possible that he was arrested twice and still was driving when arrested for the 3rd? The first one was pled down to wreckless driving, and the 2nd was awaiting trial when I pulled him over for the 3rd one. The guy was an alcoholic, so going to jail was one of the few ways that he was going to stop drinking (at least while he was in jail) and maybe make a change in his lifestyle. Someone who has a single DUI and had it more than 20 years ago will surely not be targeted.
