Post subject: | Wife got sent home from work |
My wife had surgery two weeks ago and was to return to work tonight. Doctors orders said no lifting over ten pounds for five more weeks. Typically this has no effect on her job (big retail chain) unless they put her up front to cashier which is not her normal job there. The manager on duty looked at the note and sent her home. Said she cant come back to fully healed and needs to see personal tomorrow. Also mentioned that if it is going to take five weeks to fully heal they can't hold her job for her. This doesn't seem right. She can perform the duties of her normal job there so why can they send her home like this? |

This manager sounds incompetent, and will likely be fired for not consulting HR. Your wife will have her job back tomorrow. |

Pretty sure she is over the hours and has been there over a year. I get to with her tomorrow morning when she goes to talk to the HR person. Five more weeks off would no pay would not be good for us. The job she has now doesn't pay very well but enough to get by. I guess we could both, "Get.Better.Jobs" but easier said then done. |

I'm just kidding. Times are tough, and the whole thing sounds like bullshit. Mention the word attorney a couple times during the meeting. If everything you said is true, that manager is not equipped or educated enough to deal with the situation. I think you're good. |

Have her stick a banana up her manager's tailpipe. That usually works. I think you are covered here. No way HR/Personnel is going to let someone be let go over a short term disability. |

The employer has no obligation to take her back until she has no restrictions. Sorry. |

If the employer puts her to work and she gets hurt again or gets hurt further, then she could sue her employer for quite a sum of $.Not sure about the holding her job thing, but I know I can't have anybody back to work until I have a DR note that says "full release" or "may return to work without restrictions" |
