I don't know anything about this case, but I have a hard time with the concept that if a woman is drunk she suddenly isn't responsible for her choices. If that's the case, why do we treat DUI as a capital crime? I'm not saying that a guy should be taking advantage of fucked-up girls, but just because a woman had poor judgment due to consuming alcohol doesn't necessarily make it a rape.

If something wasn't a rape at the time, it isn't a rape after the fact simply because someone regrets what happened.

If I drink to the point of poor judgment and get in my car to drive, no one cares about my poor judgment and acts like I'm some victim. No, society considers me an arch criminal. So doesn't it follow that if a woman gets herself in that same state, she is just as responsible for her choices as the drunk driver? Is she a victim or a participant? I'm not talking about someone unconscious here.

I feel like I told this story before on here, but if not.....I remember when I was 16, I was at a party, and this girl I was interested in had a few too many and was very tipsy. I invited her back to the crib, and she seemed like she was down, but my cousin, who was also at the party, told me not to take advantage. So I just took her number and we talked on the phone a few times and that was it.


Years later, my cousin told me "Shit we were young....had that happened now, I would have told you to hit that!"

The woman told police she initially didn't know who assaulted her. She identified Winston, who is black, about a month after the alleged assault.
