Was ticketed on an under-construction road today that I access from one of the exits in my subdivision. The cop was quick to tell me the speed limit was 20 MPH posted, which I thought was odd since I didn't see a sign.

I found out why on the way home from work. The 20 MPH sign is about 5 to 10 feet to the right of my access spot to this road, facing westbound. I was traveling eastbound. The sign is completely unreadable and unnoticeable from where I entered the road.

Should I fight this one?

You should be lucky you aren't getting hit with a huge fine for speeding in a construction zone.

Yeah, if you are just getting a standard fine...

Yes. Even the smallest "I could not reasonably have noticed the posted sign" argument usually wins. The onus is on the town / municipality to make sure the signs are noticeable to all possible traffic. Construction speed limit signs are temporary, so the construction folks are usually lazy about making sure the minimum posting requirements are met.

Fight this one.

totally agree about the under construction part. But this construction has been going on for about a year and the speed limit has been 25 the whole time. These temporary 20 MPH signs just showed up this morning.

You should be taken out back and shot like a rabid dog and then fed to the gators. Next!

Retrace your entire route, and take pictures of the signs, signal patterns, etc.

My brother is a cop, he confirmed that quotas exist, and it sucks but if you make things the least bit difficult to prove, the charges will be thrown out. It sucks having to appear in the first place, but that's a different conversation.

Plead not guilty and ask for a court date. The minimum fine is 375 plus court costs for speeding in a construction zone.

fight it. if it really is like you say it is, stand up and use your rights. you should have retraced and taken some pics/videos of the non-existent signs

My son fought a construction zone speeding ticket. The fine was cut in half.

Just tell the judge that you were racing home because your friend was about to commit suicide because his dream of becoming a banker was dashed again when he was turned down by another bank. Sure you were speeding but it was to save another man's life.

Have your wife drive, and video your route showing that the sign is not there.
