You guys always offer good help and I need some on this. It's about custody of a 2 year old kid. I help watch this girl's kid, the mother is a little worried the father could get custody of him, I just wanted to check if she needs to worry. About a year ago, they were a couple and all living together, but they would fight all the time, starting last summer, she started to work, so we would watch the kid on the weekends. Now she is trying to make it in Chicago, so the kid pretty much lives at the house, starting the weekend after Valentines, he has been here for every day, except maybe 5 days. THe dad only really wants to see him on holidays, dad had him Thanksgiving, Valentines, and after that didn't see him till Easter, truthfully Im probably more the like a dad to the kid, than his own dad. When his dad came to get him on Easter, the kid didn't go near him and hid behind me. She has no problem if the dad wants to see him, but wants him to be a dad and not just want him on holidays. The only thing I think he has is that he's married, but I guess he met a girl, and one of those like met and got married right away, not sure why, but don't think she's pregnant. He may have a better job, but his job is one where he is a welder and goes all over the country, so he's not home during the week. My question, is the mother ok, yea she may be in Chicago, but I talk to her everyday, Ive known her for a couple years. I will ask this, maybe someone knows about this, is it an Indiana law, there's a 99.9% he is the father, but never was proved, because her mother says he would have to pay for a blood test. |

my advice is be very careful. i couldnt count how many girls used the "he might take custody, can you please marry me?" angle. i dont know the situation though i would imagine since its not "proven" he is the father- is he on the birth certificate? if hes not, she has little to worry about. also, unless he can prove the mother is a drug addict or cant hold a job for more than a month, he wont get custody. hell, i have a friend who got full custody of his two boys at age 4 and 3 because the mom couldnt handle the kids... she didnt want them. but fast forward 4 years and she suddenly wanted them back and he lost all custody because she makes more money than he does. he just about went to contempt of court for screaming at the judge calling out the bullshit at the end of the day, the mother almost ALWAYS gets the kids if she wants them. 99.9% of the time. thats part of the reason i never want kids, because as a guy thats an investment that you certainly arent guaranteed anything |

I don't see her doing the marrying thing, but I could see why the father had gotten married, they basically got married after meeting each other, thought a reason was maybe she was pregnant, but that's not the answer. |

If she doesn't need a lawyer and it does sound like she is safe, his name is on the certficate |

Its pretty hard for a woman to not get custody.. Unless she's all whacked out on method or crack ..even then ..they get custody after a couple months of being clean. |

It's ok, you guys pretty much had the same thought I had, I just wanted to make sure, I hope it doesn't come to getting legal representation, but it could. |
