I see where she's coming from, but at the same time, a bar could serve someone up to a 0.09. Someone who isn't hammered, but legally intoxicated. |

I don't see where she's coming from. I know the family is grieving but this lawsuit is dumb. She's blaming the very first bar they went to? Get the fuck outta here. |

Unless this dude was throwing up on himself and they continued to serve him, the claims against the bars are going to be dismissed. |

That one bar we were talking about(with the stupid dress code), Bottled Blonde, might be finding themselves in trouble too. Some shit bag after leaving was doing 100 mph, crashed, killed the girl and the coward fled. Thankfully he did the right thing and hung himself. |

In a dramshop case you sue every place the guy drank and then eventually blame is assigned to the places where its established the guy became intoxicated. As for the big picture question as to why dramshop exists in the first place there are clear policy reasons why its a good idea and necessary for society to hold bars responsible for getting people liquored up and then sending them on their merry way. In a Utopia everyone is responsible for their own actions. We don't live in a Utopia. |

The damages are limited to only $75k or something. It's largely symbolic. |

Until you start discovery you won't know exactly where the guy got hammered. Can't start discovery until you file suit. So have to sue every place just in case it turns out that's the place where it happened. If you just assume a bar isn't going to be liable and leave them out of the suit and then it turns out he did 7 shots before walking out the door, but you found that out after the SOL has passed you just committed malpractice. |

Just don't take a case where some dumbass family wants to sue someone who didn't do anything wrong. Problem solved. |

FF is cool, he's a fellow member of team weed. He doesn't like/understand dramshop which is not a big deal, lots of people don't. There's nothing cut and dry about it, it's a pretty complicated law when you start examining the reasoning for it. I've had this exact same discussion before with intelligent people. |

Well,If M.A.D.D. gets their way. Evey place that serves alcohol will have to have a licensed calibrated breathalyzer machine. As you leave you have to blow, if you are over the limit the establishment has to provide you with a ride home |

Bartenders and servers used to be required to take a TIPS class to avoid over serving, in order to work in a place that sold liquor. Is that still the case shakes? |
