Quote:
Two New Jersey men sued Subway this week, claiming the world's biggest fast-food chain has been shorting them by selling so-called footlong sandwiches that measure a bit less than 12 inches.

Stephen DeNittis, the lawyer for the plaintiffs in the New Jersey suit, said he's seeking class-action status and is also preparing to file a similar suit in Pennsylvania state court in Philadelphia.

He said he's had sandwiches from 17 shops measured — and every one came up short.

DeNittis is asking for compensatory damages for his client and a change in Subway's practices.

I need SHARK's opinion on whether sub size matters.

So you can be sued for providing something that isn't as long as you said it was?

Damn. I gotta make a call.

Nomination DENIED!!

I pay for a footlong I should get a footlong, not 11 inches.

Seems petty, but there is supposed to be truth in advertising. Nomination denied.

I'm surprised a man was the first to discover that he was getting the full 12".

this story's like a week old...

Diggstown is Olivair County.
A day is 24 hours.

It seems to me that if you paid for the sandwich and ate it without registering any complaint about the sandwich measuring less than the 12 inches it's supposed to be, that you are S.O.L. at this point. How can it be proven that any sandwich that was previously eaten, was in fact undersized? The guy that measured his sandwich and filed the lawsuit has a case. But all those that failed to ascertain the exact size of the sandwich prior to it's consumption, probably are going to be excluded from any class action lawsuit at some point. It has to be shown that each member of the lawsuit was in fact the victim of fraud.

I can only speak for myself, but most people know 12 inches when they see it.

And, really, just like a "Quarter Pounder," being a burger's weight prior to cooking, couldn't Subway just claim it was 12" when we made it, but in wrapping there might be....erm, shrinkage?

I mean...no. Considering you watch them make the entire thing, and a healthy percentage of Subway's sandwiches aren't "cooked" by any method.

Their bread is rather soft. I'm pretty sure wrapping it in wax paper then shoving it into a glorified newspaper delivery sleeve will knock it down in size.
