Did you know that if you go to a baseball game and get hit by a foul ball or errant bat, you have little chance of a winning a lawsuit? "The Baseball Rule" says that by purchasing a ticket and going to a game, fans are putting themselves in danger and assuming liability.

But last week, in a rare ruling against "The Baseball Rule," the Idaho Supreme Court balked at convention and said a man who lost an eye after getting hit by a foul ball can seek damages from a baseball team.

The only time this kind of ruling would make sense to me, is if the ballclub were to have failed to install fencing/netting in the area behind the plate (leaving fans in an unusually dangerous situation) or had no railings at the front of upper deck seating areas ( to keep fans from falling) which could be seen very easily as negligence. Otherwise, the fan should know that there is risk involved with foul balls they need to be prepared for.
