I was just thinking about this one the way to work. On it's face, it does appear to be nothing different than taking fingerprints. If you delve deeper, the ramifications are much greater. We are like children in Eden with some of the technology available to us. |

Agree. I kept debating with myself if this is the same as fingerprints, and it seems much more intrusive. I don't like the verdict. Charge the person with a crime and get a court order. Then draw blood. It's not like they have Lance Armstrong like money to get a transfusion. Their blood will still be there. |

This should be a big fucking deal. I believe I read about this last night and was instantly pissed. I know a lot of people may believe it is harmless but they couldn't be further from the truth. More black and brown men will have their lives destroyed by this. Also when the technology is there many "Lee Harvey Oswald's" of the world will be wrongly framed and convicted. In less than 20 years minor traffic violations and other misdemeanors will require you to give up your DNA. Of course human error will never come into play. |

Nas, I see both sides of this, but I am strongly with you. I have a big Libertarian bent, and I don't trust the government to play by the rules. I am sick of secret courts, warrant less wire taps, extracting information from telecommunications firms, unaccountable drone strikes, Gitmo, "enhanced" interrogation techniques (torture), and all the other crap that goes on in the name of safety and National Security. I also hate the crony capitalism that RPB has railed against in other threads. Our country likes to hold itself out as a defender of freedom, but it seems like we're hypocrites. I don't trust the police to administer justice fairly, and that's why we have courts to get warrants including the drawing of blood. The Supreme Court surprised me on this one. |

As an aside, I was pleasantly surprised that the vote didn't go along perceived "Party" lines. Good to see a couple judges showing an ability to go with what they believe is right, and not along what the public sees a "conservative" or "liberal" judge should be doing. |

It seems like many of these justices don't live in the real world. IIRC they ruled AGAINST something very similar last year and they didn't put any MAJOR crime restrictions on their ruling yesterday. They're basically telling the states to feel free to expand. Congress won't pass any laws to limit the intrusion into our privacy because they will consider it STATES RIGHTS. |

The USA has the highest incarceration rate of any country in the world. Many for non-violent drug possession. Two justices (Scalia and Breyer) jumped their purported left/right leaning ideals and voted the other way. One liberal and one conservative. I didn't think that would happen. That was my point. Justice Anthony Kennedy wrote the majority's 5-4 decision, in which one liberal justice, Stephen Breyer, concurred. The key to the ruling, Kennedy said, is "reasonableness." Justice Antonin Scalia wrote an angry dissent for himself and three liberal justices, charging that the decision will lead to an increased use of DNA testing in violation of the Constitution's protection against unreasonable searches. |

Much like gay marriage recognition, drug legalization seems like an unstoppable tide. Several Latin American countries are pushing for a change in U.N. policy. Apparently, there is a global agreement to keep drugs illegal. But our neighbors are getting sick of being trafficking routes for drugs destined for the U.S. |

You don't have to make crystal meth decriminalized to provide better health services.If the United States legalized marijuana, kept the rest of the laws the same, and invested in more treatment and counseling services, it would be the best of both worlds. |
