NEW YORK (Reuters) - New Jersey's mandatory quarantine for certain travelers from Ebola-stricken West Africa will likely face its first legal test this week, after a lawyer for a quarantined nurse said she would file a federal lawsuit within days.

Norman Siegel, a civil rights lawyer, said Kaci Hickox's isolation upon her return from West Africa raised "serious constitutional and civil liberties issues," given that she shows no Ebola symptoms and has not tested positive for the disease.

"We're not going to dispute that the government has, under certain circumstances, the right to issue a quarantine," said Siegel, who was on his way to visit Hickox in a New Jersey hospital. "The policy is overly broad when applied to her.”

The lawsuit would be the first to challenge the 21-day mandatory quarantine imposed by New Jersey for anyone arriving with a high risk of having contracted Ebola from Sierra Leone, Liberia and Guinea, where the epidemic has killed nearly 5,000 people.

The case could also affect similar policies announced by other states including New York and Illinois.

The lawsuit will argue that Hickox's constitutional right to due process was violated when she was forced into isolation, Siegel said.

State officials implemented a blanket policy without identifying a rational basis for confining asymptomatic individuals like Hickox, he said.

"The case law makes clear that the policy should be driven by medical fact, not fear," he said.

Michelle Mello, professor of law and public health at Harvard University, said courts in such cases seek to balance the level of danger posed by the disease with the likelihood that the individual poses a public threat.

But she said courts have found reason to uphold past quarantines, even when there was no definitive proof the individuals were ill.

"I don’t think it is clear, but I suspect when all is said and done, it won’t be successful," she said.

Lawrence Gostin, a Georgetown University law professor and health expert, said states' authority to issue quarantine orders is broad, but not unlimited.

"I can’t recall a case in the 20th century where certain states are preparing to quarantine an entire class of people irrespective of their individualized risk," he said. "It just flies in the face of science, ethics and law."

In such cases, courts typically seek the least restrictive alternative, Gostin said, which might include voluntary confinement with monitoring. He said other quarantines, such as for drug-resistant tuberculosis, require a positive test.

Gostin has been in contact with Hickox via email to offer advice and support, he said.

Hickox, the first person isolated under the new orders, arrived on Friday at Newark Liberty International Airport in New Jersey after working with Ebola patients in Sierra Leone.

In an interview with CNN on Sunday, Hickox criticized the policy, saying she is "completely healthy."

But New Jersey Governor Chris Christie told Fox News on Sunday he would not back down. "This is government's job ... to protect the safety and health of our citizens."

The White House, worried that the quarantine orders could impede the fight against Ebola, has voiced its concerns to the governors of New Jersey, New York and other states, a senior administration official said on Sunday.

You know, I agree. She made the decision to go help out in Africa, she needs to accept the consequences and be isolated. I'm tired of these health care workers, the so-called experts, flying in the face of what seems to be common sense. Snyderman from NBC, the doctor in New York, the cluster fuck that happened at the Dallas hospital. It's noble work, they have my respect for doing it, but you cannot jeopardize everyone else because you're made uncomfortable. You signed up for the duty. This is the occupational hazard that comes with it. Deal with it, bitch.

"After consulting with her, she has requested transport to Maine, and that transport will be arranged via a private carrier not via mass transit or commercial aircraft," the department said.

Senior officials in the Christie administration said she will be driven in a car and escorted by officials from the state and Doctors Without Borders, the agency the Hickox worked for in West Africa.

"Health officials in Maine have been notified of her arrangements and will make a determination under their own laws on her treatment when she arrives," the New Jersey statement said.

Hickox's release appeared to be a reversal by the Christie administration. The governor defended the mandatory 21-day quarantine order on Sunday.

Christie, who was in Florida today, said that "when she [Hickox] has time to reflect, she'll understand" the quarantine, according to the Associated Press.

Hickox, 33, hired civil rights attorney Norman Siegel to fight her mandatory quarantine. The nurse has said she feels that her "basic human rights are being violated," kept in a isolation tent at University Hospital in Newark, despite showing no symptoms of the Ebola virus.

First responders know full well what they're getting into and the support and appreciation of the people should not be counted upon. Fear and ignorance will keep you safe so long as they are quarantined from you. In the meantime, cancel all flights from Africa (and anywhere else for that matter). Be suspicious of anyone dark who talks funny or white who doesn't share your fears and reticence about helping others. Finally, don't wait too late to get any of your children a plague mask in their size, one size does not fit all.

Well, like I said (verbatim) in my earlier post, they do noble work, and I respect them for it. But, I don't care, "expert" or not, I'm gonna err on the side of caution. I couldn't be farther from living in fear, but I also don't play in traffic.

An American doctor who caught Ebola while treating patients in Guinea was a hard worker who conscientiously followed safety procedures, two colleagues said Saturday.

Craig Spencer is being treated for Ebola in New York City after coming down with a fever on Thursday, about a week after he returned from Guinea. The 33-year-old was working at a Doctors Without Borders clinic in Gueckedou, in southeastern Guinea, according to two members of the clinic's staff.

The staffers - a hygienist and a social worker - spoke on condition of anonymity because they were not authorized to talk to the press. Doctors Without Borders has confirmed an American doctor is ill, but it has refused to release details about Spencer or his work, citing concerns for his privacy.

Gueckedou is the epicenter of the current Ebola outbreak in West Africa. The first cases were reported in that region in March, and the epidemic has since grown into the largest ever outbreak of Ebola, with more than 10,000 cases and nearly 5,000 deaths, according to figures released by the World Health Organization Saturday.

"We are demoralized and saddened by what's happened to Craig," said the social worker, who supports patients during what is typically a grueling and frightening illness. "He did excellent work."

Spencer's work included direct contact with sick people: taking their temperature, following the evolution of their cases, taking their vital signs and ensuring the clinic was properly maintained, he said.

"I'm asking myself how he got the virus because he was a rigorous man," added the hygienist, whose job is to clean patients, who often have severe diarrhea and are vomiting and bleeding profusely. "Since we learned that he was infected, we've had low morale. And we understand that we are also at risk despite the measures."

Doctors Without Borders has been a major provider of care during the current Ebola outbreak and in all recent ones. Its procedures for everything from how clinics should be set up to how doctors and nurses should take off protective equipment are considered the gold standard when dealing with highly infectious diseases, like Ebola.

At Ebola clinics, there are elaborate procedures for how health workers undress and disinfect their equipment and the site, and the hygienist said the disinfection teams at Gueckedou make sure those procedures are followed to the letter.

But Doctors Without Borders has warned that no matter how careful health workers are, the risk can never be zero. It said Friday that it did not yet know how Spencer became infected but that it is investigating.

Staff at the Gueckedou clinic are also redoubling their efforts to stay safe, the hygienist said.

"Since his sickness was announced, I've seen the bosses here looking to reinforce our protections and to see where there are weaknesses," he said.

Both workers said they thought the Gueckedou clinic is well maintained, with nothing taken for granted.

The hygienist said: "We are praying for Craig and for ourselves because we rub shoulders with death every day."

I think the conditions of her quarantine could have been a little nicer/more comfortable, but I don't think the quarantine itself was unreasonable.
