WalletHub, a website run by Washington, D.C.-based Evolution Finance that allows people to compare options for credit cards, loans and other financial products and services, went public today with details of a two-year negotiation with MLB before the U.S. Patent and Trademark Office over use of the letter in its logo.

Evolution Finance applied for a trademark to its W, which is white with a green background, in February 2012. That action prompted opposition from MLB on behalf of the Cubs and the Washington Nationals, which said it could be mistaken for trademarks that either team has on the style of such a W. In the Cubs' case, the league points to the blue W on a white background, an image the team has trademarked for commercial use. The Cubs raise a flag with the logo after wins and even used it as the centerpiece of their marketing campaign in 2010 with the tagline "It's a Way of Life."

But after two years of trying to hammer out guidelines on how and when WalletHub may be allowed to use its logo, the company's CEO today called out the teams for being "bullies" in a post on the company's website.

"Aside from the fact that none of their marks look anything like the WalletHub logo (and very few people would associate the Cubs with W's these days), they're also registered for clothing and flags while WalletHub's logo is for financial services," WalletHub CEO Odysseas Papadimitriou wrote in a blog post on his company's website. "I suppose this type of frivolous corporate bullying is simply what you have to endure as a growing startup these days."


Why does this company have a problem with being sued? THEY TOLD YOU WHAT THEY'RE DOING.

:lol: It's funny how the Cubs were less of a ruthless corporation when actually owned by a ruthless corporation.

The judge will throw this case out by saying "Both in MLB, and outside of MLB, the Cubs are not associated with the letter W".

Good point, but couldnt one argue that the Tribune's attitude of ambivalence toward the product on the field (because the bottom line is all that matters and that was fine) would be the ultimate in being a ruthless corporation?

Yea, from the article the Cubs didn't initiate this lawsuit.

Agree, but remember I am sure the Cubs or MLB pay a large law firm a ton of money to do a daily search to see if anyone is encroaching on a use. I would guess that the pursuit of this has legal pushing behind it. nice fees if you can get it.

HOWEVER, Having a Blue W on white background flag and selling it, is what they would go after.

Combinations of colors, fonts, applications is what is protected,

Try and open a Real Estate company with the name CENTURY in it or a Company that has a signed with Red, white and blue on the front and see how that works out for you.

If it was an app in a different space then you'd probably be fine.

That is why this is just embarrassing for MLB and the Cubs and the Nationals. They can't honestly believe they somehow own the letter W.

Well, there may be something to the argument that every other team is on the same basic schedule. That really shouldn't be much of an issue anymore as the Cubs' day schedule has been drastically reduced.

They were just over .500 including their dominant run from 1880-1910.

They were just over .500 including their dominant run from 1880-1910.


They were 1,100 games over .500 for approx the first 60 years of their existence (1876-1936) and then 600 games under .500 for the next 77 years.

Big time IP attorneys are paid tons of money to view these searches daily. They find anything that looks like anything they have and send a C&D letter.

This is 100% an attorney making someone aware of a situation and while they are not committed to it, they know that allowing it might be a mistake one day and they dont want it on their head, so they make an issue out of it.

I would say that if you really wanted to spend the money and fight this, you would win, but its like the NFL, they lose a large number of cases that go to trial...if you can outlast the deep pockets of the NFL. Not many can,
