Post subject:  MLB fires arbitrator who overturned Braun suspension

Shyam Das, who provided the key vote in the landmark ruling that overturned a suspension for 2011 National League MVP Ryan Braun on drug-related issues, was fired last week as baseball's independent arbitrator, USA Today reported Monday.

Das had held his position since 1999. The independent arbitrator is selected by the players' union and Major League Baseball, and either party can terminate the person at any time.

Major League Baseball has not yet announced the dismissal, but USA Today confirmed the move based on anonymous sources.

The players union and MLB must agree on his successor.

A three-person panel ruled on Braun's appeal of a 50-game suspension after he reportedly tested positive for a banned substance. A representative of the players' union and Major League Baseball as well as the independent arbitrator form the panel, and the arbitrator typically casts the deciding vote in issues such as Braun's appeal.

Das ruled that a drug sample collector had failed to follow protocol when Braun's sample was collected and sent for testing. Das, therefore, ruled in favor of Braun, overturning the suspension of the Milwaukee Brwers' outfielder.

Rob Manfred, MLB's vice president of labor relations, subsequently criticized Das's decision, saying, in part, that “Major League Baseball vehemently disagrees with the decision rendered today by arbitrator Shyam Das.”

Das has also been the arbitrator for the NFL since 2004 and is scheduled to hear an appeal in the New Orleans Saints bounty case on Wednesday.

Not sure how an "independent" anyone, who must be agreed upon by both parties, can be fired.

I guess in this case MLB and the MLBPA agree upon such arbitraitor well before issues arise.

When you work "Independently" you dont work for anyone, they hire you on a job by job basis.

If they choose not to continue to use you, they just didnt hire you again, happens all the time. You didnt get FIRED.

I'm guessing the role of baseball management/labor arbitrator isn't a job-by-job basis, though. The third party is probably on retainer. I suppose the union could fire the "independent" board member if they wanted, as well (and probably will fire the next guy, just to swang their dicks).
