Or at least become active by going to HOA meetings. My wife and I were getting screwed with multiple fines for a few items that were 100% false. We started to go to meetings, and these fines vanished, and we haven't heard a peep from anyone in a couple years now. People will be less likely to accuse you of anything to your face, so by being at the meetings, they will probably be frightened to air any grievances. Our meetings are just quarterly, so we only have to invest about 4 hours a year with them, and they are actually humorous to see how petty some people can be.

Going to those board meetings can be a tricky thing. If you get too vocal you have people saying, "Why don't you run for this board and do some work?" I guess some people like that type of thing. It looks like, in this case, where you have a lax/under-funded HOA, the only time "just do"ing will likely come to bear is when you are looking to sell the property. When you do, and you request an accounting and paid assessment letter, a huge fine may show up, or they may claim a lien or open violation at that time. That is probably the only place they can "bite" if they are under-funded, but that is a pretty big concern if you ask me.

Like SR said, petition for a variance based on the procedures as outlined in the Dec., all the while politicking with the local gentry to assure you will have support this time.

Might be a damn good idea to run for president of the Board and work on amending the Dec, too.

Last gasp: find out who the Board's attorney is (info might be on dec) and contact him/her directly. Often times, the wacky Board lawyer can talk some sense into the wacky Board members, or otherwise agree with you and give you a roadmap to success!

A lot of times an "opinion letter" could lead to an inheritance of a pretty good amount liability on the writer, regardless of how the wording is couched, and, at the very least, someone is likely going to try and rely on it to their benefit (and hopefully not to their detriment!), so I don't see a problem with the $900.00 fee. It is a lot cheaper than bringing or defending a lawsuit.
