I'm a little shaken up boys and girls. I just witnessed an extremely old couple drive their car into the Panera next to my office at 60mph. The entire car is inside the Panera. Several people injured. Guy kept his foot on the brake while he was still in there and the smoke and smell from the burning tires was out of control. It sounded like a bomb had gone off.

People crying and screaming. Mayhem. I'm still shaking.

I assumed since you were posting and presumably OK I could make a joke about it but I do sincerely hope you and everyone else is OK. Sounds like some people have to have some kind of injuries, doesn't seem like there's room to park a car inside a Panera

It happened on Wilmette Ave. in Wilmette - a couple blocks from the Metra. I hope everyone is ok too. I saw three people taken out on stretchers. The police interviewed me because I actually witnessed the damned car hop the curb and blast though the window. I'm still shaking.

I took a photo of the old couple as they were being escorted into a cop car. I tell you . . . they were very old. Several people who were in the restaurant were bitching about old drivers. I can't even forumulate an opinion on the matter yet.

I'm ok.

Not to derail, but I saw a bad accident this weekend. Two people on a motorcycle got hit by a pick-up at the intersection of 59 and 68. One died at the scene, one died while being air-lifted. Neither were wearing helmets. Shook me up to see that. Be careful out there.

There has to be stricter laws in regard to elderly drivers. After you reach a certain age, you should be tested every year thereafter. Sounds harsh, but I think it would cut down on a lot of accidents involving older drivers.

OK folks, the over/under on the next big discussion in Illinois House/Senate regarding changing the licensing of the elderly is hereby set at 7 days.

I'll take the under.

Everytime a geeze does something like this seems that there is a proposal to re license them on an annual basis, instead of the current 5.

My grandma was still driving at 92, albeit just to church, Walgreens, Jewel, etc. In other words nothing more than a couple miles away. She voluntarily decided not to drive anymore shortly thereafter. Maybe some people just don't know when to give it up or are too stubborn

old poeple should be tested every year, or maybe twice a year.

they're health/reactions, etc can deteriorate more in a few weeks than younger peoples can in 6 or 7 years

higher curbs would stop a car....
NSJ, is the curb rolled there? or is it standard 6" barrier curb? 6" should have stopped the car. 9" would hang up on the transmission for sure.

Well. I had to do it. Went back to the scene and was interviewed by every station in Chicago. They all want me to to email the photo I took of the couple. The reporter for CLTV Gaynor Hall was stunning!

The Appellate Court, 355 Ill.App.3d 685, 291 Ill.Dec. 805, 824 N.E.2d 661, reversed and remanded. Restaurant franchise and restaurant owner appealed.

Justice GARMAN delivered the judgment of the court, with opinion:
***899 *424 Plaintiff, Detroy Marshall, Jr., as personal representative and administrator of the estate of his son, Detroy Marshall III, filed a negligence action in the circuit court of Winnebago County against Burger King Corporation, Davekiz, Inc., Pamela Fritz, and various insurers. The decedent was killed when a car driven by Fritz crashed through the wall of the Burger King restaurant where the decedent was eating and fatally injured him. Plaintiff alleged that Burger King and Davekiz, Burger King’s franchisee, did not exercise due care in designing, constructing, and maintaining the restaurant and that their failure to do so proximately caused the decedent's *425 death. Burger King and Davekiz filed a joint motion to dismiss the allegations against them (735 ILCS 5/2-615 (West 2002)), which the circuit court granted. The appellate court reversed and remanded the cause for further proceedings. 355 Ill.App.3d 685, 291 Ill.Dec. 805, 824 N.E.2d 661. We affirm the judgment of the appellate court and hold that the allegations in plaintiff's complaint are sufficient to establish that Burger King and Davekiz owed a duty of care to the decedent.
