Here is the situation. Vehicle was hit while sitting at a sports field. Had some pretty good damage but nothing that would keep the vehicle from working or anything. Teenage boy is the one who hit it with his truck. Boys parents were right there and talked to me. They asked that we not go through insurance for the damage because they did not want their insurance to skyrocket. I understood and told them I didn't want anyones insurance to go up I just wanted the damage fixed. They assured me they would pay for all damage to the vehicle. They gave me all their contact info and told me to let them know when I knew the amount. I got an estimate for it and called the guy. He said he would have me the money in a couple days. He brought me a check tonight for the entire amount. Now it has left me this evening wondering what is the right thing to do? Should I get the vehicle fixed and use the money for that? Should I pocket the money and keep driving the vehicle with the damage? I guess I assumed that they would just want to pay the business that we went with to fix the damage. I never thought they would just give me the money directly.

Once you get the check it's up to you. No different than an insurance company cutting you a check and you decide to get if fixed somewhere else cheaper and pocketing the difference or not getting it fixed at all.

Same thing happened to my dad when i was in high school. It made no sense to fix his truck as it was only cosmetic. They gave him a few hundred and that was that.

To some extent. I'd still be pissed if I ended up giving a couple thou to some guy to fix his car and then I see him six months later without repairing it. Even though I think you are in the right to do with it what you want, and even though I could rationalize that thought as the father of the kid that hit you, I would still not be happy about it.

Same thing happened to me a few years ago. Teenage kid with his sweet 16 birthday gift, an f'ing Excursion, hooked my bumper in a parking lot and ripped it clean off. The parents said the same thing, that they wanted to avoid insurance, that they would pay for everything. Mistake.

I got an estimate from my guy. I told her that I wanted a check for the estimate, plus $250, to cover any overages. Once the work was done, I'd give her the receipt and a check for the difference. The mom went batshit crazy. She insisted that I take it to her guy and have him fix it. I refused. She said "why should I trust you?" I said "Fuck you! Your family caused this, you're asking me to do you a favor. It's all on you!"

I turned it into my insurance and got it fixed and got an additional $500 from her insurance for my trouble, once it was settled. F her insurance rates!

I found out later that his daddy was the CEO of a major area hospital system, and she's bitching about $250, which she most likely would have gotten back.

People suck.

someone hit me years ago on my way to work. he was an immigrant who i don't think had insurance. he asked the same thing, obviously. i got an estimate and told him what that was, and he gave me a check.

same thing, damage was cosmetic. there was one thing i had to fix at midas that was $30. i just pocketed the rest.

if they're willing to pay for the damages, knowing they did something wrong, then there's nothing right or wrong for you to do. i think it's a bit cruel to add punishment when they've already tried to do the right thing.

Yep. About ten years ago I was riding my bike west on Oakton across the street from James park. I got alongside a white van and suddenly the door flew open. I tried to slide the bike to the left and for a split second I thought I managed to get clear with minimal bumping, but then the handlebars caught the mirror and the bike and I were in the air going over the top of the door. Thank God there was no traffic on Oakton and thank God I didn't land on my head because I'm too dumb to wear a helmet. I went bouncing on the pavement on my knees and the bike came down and slightly grazed my back.

I got up in a fury and immediately started motherfucking the guy. He was a middle-aged black dude who looked like he was coming from working construction or painting. He looked puzzled as if he didn't know what happened and started apologizing but also acting like it may not be his fault. I told him we had to call the cops. A cop came and talked to us separately. He talked to him first. When he came over to me he told me the guy had a spotless driving record and was insured by State Farm. The cop said he was writing a ticket but that I might want to think about not showing up to prosecute as long as the guy or his insurance took care of the damage. I wasn't looking to hammer anyone. The guy seemed like a decent person. I just wanted my bike fixed.

So the guy says he doesn't want to go through his insurance and to let him know how much the repairs will be. We exchanged phone numbers. I took the bike to my buddy at Village Cycle. The bike was fucked up. It was $250 to fix it. I called the guy and told him. He said okay and that he would send a check. Well, a couple weeks go by, no check. I call him. Now he isn't answering my calls. I say, fuck it, I'm filing a claim. I'm insured with State Farm too so I call my agent.

A couple days later I follow up and I'm talking to some broad in Bloomington. She tells me they spoke to the guy and he is claiming I ran into his door. What the fuck??!! I told her that there was a police report, the guy was on record admitting he winged me with the door, he had received a ticket, and I was heading to my doctor's office to be fitted with a neck brace as soon as I got off the phone with her because I was beginning not to feel so well as a result of the accident. I told her I was going to see a lawyer and I'd be looking for about 15 grand if I didn't get my check for $250 immediately. The next day I received a Fed-Ex package from State Farm with a check.

People do suck.

the first car i got in high school was an 85 Corolla that was my grandma's....it was in pretty damn good shape but it was still a 85 Corolla
one day i was parked on like 114th and Western or thereabouts, somewhere just south of 111th...come out of a store or something and just see some guy peeling down Western sideswiping the car, took off the mirror and scraped the side pretty good
State Farm evaluated it and ended up giving my dad ~1K for it, was shocked as the entire car couldn't have been more than 2 or 3K max
my dad pockets the cash, doesn't have it fixed....wasn't my fault at all and now i'm driving around in a 85 Corolla with a busted up side

Then either don't hit the car, or make sure your kid doesn't hit the car. Or have your kid pay back the $ over time.

I had a high school kid back into me this winter because he didn't defrost or scrape his window. I didn't want to call the insurance company right away so I had him give me all of his information and his house was right around the corner. Spoke with his dad and we worked it all out and he wrote the check out to me. It was for like $700.00 worth of damage and I got it fixed, even though it was nothing that would have kept my truck from running. I would feel guilty taking the money and then seeing them at the ballpark later and not having my vehicle but I am sure that is just me.

You've taken down the resale value considerably. However, if you plan on keeping the car until resale value doesn't matter that much then it's not a big deal.

No reason to feel wrong for not fixing it. You still lost money due to the damage. You have a car that is worth less than it was before.

Well for starters, my kid hit their car, not me. :)

I understand that it doesn't make sense for me to be pissed, which is why I said I could rationalize it in my head why I shouldn't be pissed, but I've basically given money to someone for "damages" that they don't care about. I also understand that this could affect the resale value depending upon the condition of the car (but that would make me wonder even more why they weren't using the money to fix it if it would up the resale value.) I'd also be pissed at the kid and most definitely he/she would be paying it back... he/she needs to learn to be more responsible.

Underscoring again, I understand this does not make logical sense. If posts had to make sense on this board, we'd have about four a week.

Resale value only matters when you are selling the car. RFDC lives in Missouri, which means this car is likely to end up on cinderblocks in his front yard so he doesn't care about resale value.
