My wife had surgery two weeks ago and was to return to work tonight. Doctors orders said no lifting over ten pounds for five more weeks. Typically this has no effect on her job (big retail chain) unless they put her up front to cashier which is not her normal job there. The manager on duty looked at the note and sent her home. Said she cant come back to fully healed and needs to see personal tomorrow. Also mentioned that if it is going to take five weeks to fully heal they can't hold her job for her. This doesn't seem right. She can perform the duties of her normal job there so why can they send her home like this?

My wife wanted to get FMLA at work but she was told that she had to work 1,150 hours in a year to qualify.

FMLA Requirements:

Be employed by a covered employer and work at a worksite within 75 miles of which that employer employs at least 50 people;
Have worked at least 12 months (which do not have to be consecutive) for the employer; and
Have worked at least 1,250 hours during the 12 months immediately before the date FMLA leave begins.

Pretty sure she is over the hours and has been there over a year. I get to with her tomorrow morning when she goes to talk to the HR person. Five more weeks off would no pay would not be good for us. The job she has now doesn't pay very well but enough to get by. I guess we could both, "Get.Better.Jobs" but easier said then done.

I'm just kidding. Times are tough, and the whole thing sounds like bullshit. Mention the word attorney a couple times during the meeting. If everything you said is true, that manager is not equipped or educated enough to deal with the situation. I think you're good.
