My credit is fucked. I didnt save much money. My problems stemmed from a divorce. I got the kids, I want to keep them in the house until they finish high school, 3 bedroom apartments are just as much as a mortgage. I have deadbeat Caller Bob of an ex-wife who is 14 months behind on support payments, I qualified for nothing because my house isn't underwater and apparently I am a rich man according to HAMP/HARM and the bank. I don't know what the best solution is, having the kids here really prevents me from doing stupid shit.

I wont stoop to your level, but I will say that if you have not heard of people who said "fuck it" & stopped paying their mortgage, then you aren't paying attention. For God sakes, if you read the paper, watch TV, or listen to the radio you have heard this. I have friends in both real estate & mortgage lending & they say that this has become quite common.

Mike- I am sorry to hear of your troubles, I would not wish raising four kids by yourself on anyone, I am sure it is very hard.

You said you are not underwater on your house- do you mean that the house would sell for what you owe, or just that you are not behind on the payments? I understand wanting to keep the kids in the house, so make selling and moving a last resort.

First choice would be to use the divorce agreement to force the ex to pay the support- even if you had to forgive the past owed, just get it starting now. You paid a lawyer, sic them on her.

So that may not work. Lots of times you can't squeeze blood from a turnip. Cut and slash, written monthly budget with NO frills- no cable, no cell, no internet, nothing. How bad do you want to keep the house, right? Make it your total focus. Grab a part-time job if you can.

Lastly, tap the 401K/IRA. How old will you be when the kids are out of HS and you can get out from under the house/ how long will it be and can you see the neighborhood values rising in that period? You may end up having enough equity in the house by then to make up for the reduction in the retirement savings.. If you turn 50 and look back and you kept the house, raised the kids and now have to start saving for retirement, really only you are suffering, not the whole family. The positive of keeping the family together would likely outweigh the pain of starting over. and the family will see how bad you wanted it and how hard you worked for it.

So you try all that and still can't make the payments? Sell it, short sell it, last resort foreclosure. In many cases the imagined harm from downsizing is worse than the realized harm. Kids usually don't recognize how "tough" they had it.

It's not as if Scorehead is saying that everyone that stops paying their mortgage does so for their short term financial gain (no matter the long-term effect). Certainly many of those that don't make their payments are simply unable. He's saying that SOME people make that choice though, in spite of the fact that they might be able to make their payments, because their home is worth less than they owe on it and they can bank a great deal of money before they are thrown out of their home (evicted). Perhaps they even consider it only fair, because of the money they may have lost on their home after the real estate downturn....although there has been a rebound recently, many still find themselves under water. Those who cheered on the ignorant, personal attack on Scorehead's original post should really reconsider your position.
