actually yes. I have had my house raided in the past. 7 cops with guns pointed at me, claiming my house is a grow house. They had no warrant, I knew because I asked for it 3 times and they actually flashed me a blank report. The captain eventually got pissed and just pushed me back while they filed in. They found nothing but a small bag of weed, which they "had" to throw me in jail for. Police report said I let them in right away without any issue, I couldn't believe it.

My lawyer said its my word against theirs, and theres nothing I could do about it. That was the last time I ever open my door without knowing whos on the other side. Very sad I have to live like that, but it is how it is. Next time 7 cops are at my house, I will actually be thinking about shooting right through the door- where in the past I would never have thought to do such thing.

When your door is kicked in and there's a clear violation of your 4th amendment rights then yes your are a victim of mistaken police work.

So as long as the police suspect something is wrong, Rick, you are willing to waive your 4th Amendment rights without question? That's pretty scary.

Perhaps the police were correct in this situation, but if there was a next time they might have been completely wrong and more people could have died.

Yeah, but in this case they were right. He was growing a drug that is currently illegal.

Did his criminal activity justify the actions of the police? If we're gonna kick in the doors of everyone who grows a couple marijuana plants, we're probably going to have a revolution on our hands.

How do you know they were right? Without a warrant stating what they were looking for we have no idea if they were right or lucky.

They way they did it was clearly wrong. I don't doubt that.

My point is that he was growing weed like they thought.

Your point is wrong. You really don't know what they were after when they kicked in the door.

No, but if I'm doing something illegal in my home, I know there is a chance the police will figure it out. They should have had a warrant and they should have knocked and announced themselves better. I don't deny that.

So you would admit that the homeowner broke a minor law and the cops violated the constitution of the United States of America.

That's just it, Rick. I'm almost positive that you HAVE done something illegal in your home. I have no doubt that at some point you have illegally downloaded at least one song, movie, or TV show.

So you're OK with the police kicking down your door without a warrant, even though they already know you are/have been committing criminal acts in your residence?

FYI, many other articles indicate that the cops did have a search warrant.

No, I said how they did it was wrong. How many times do I have to say the cops were wrong in how they went about it? My point is that the police were ultimately right in suspecting that he was growing marijuana in there.

This guy was doing something illegal though and they clearly knew he was.

It's certainly possible. Weed is a pretty popular drug. It's not like he was operating a meth lab.
How many other doors did they bust down that day?

Are you honestly saying they didn't know there wasn't weed being grown in there? They clearly thought there was, and there was. The methods or even the necessity to bust it seems to be wrong here but there is no reason to act like this guy was simply a victim of mistaken police work.

No, the dead officer is a victim of mistaken police work. I'm not of the mindset that illegal automatically equates to morally wrong, so yeah I also think the guy is a victim here too.

No, they shouldn't have been fucking with a guy with a couple of plants. Dies a hero. Give him his wreath. Texas is now safer.

The guy is a victim because they didn't knock and announce themselves. He isn't a victim because he was growing a currently illegal drug in the house and the police had enough evidence to get a search warrant.

That's your opinion. Considering I find the law to be unjust, I obviously disagree.

Unfortunately, or fortunately, our opinions on laws don't change the fact that we accept the consequences for choosing not to follow them.

Of course. Nobody's denying that. All I am saying is that I don't consider Magee to be immoral or wrong here on any level. It's an unjust law that is slowly being phased out on the state and federal level.

The dead cop's family has to accept the consequences for his stupidity. Who care what the law says or doesn't say, if you are a cop and you are breaking down somebody's door as they sleep, you'd better identify yourself.

To me, this cop is right on par with the kid who got shot at the gas station the other night. They are both morons and reaped what they sewed.

I respect your right to your opinion, however much I may disagree with it.

The no knock thing seems stupid. I would need to see a lot of evidence where police officers were killed or injured by knocking and announcing their presence first before I could agree that the provision makes sense.

You tell em Frank! Screw the dead cop that probably was just doing what his job required in enforcing a search warrant! He didn't knock though!

So you admit he did not do his job well at all, and he is dead because of it.

Thanks.

You do realize that there are no knock warrants that are issued by a judge.

That isn't truly accurate though. Laws are broken all the time. Sometimes, they are concurrent with a social or political change. I don't think this guy growing marijuana in his house was doing anything to push forward the movement.

Are you saying he deserved to die?

At least you aren't comparing him to a person who is committing a crime any more. That's progress.
