With reports surfacing that the NBA has no actual power to remove Donald Sterling from his post as Los Angeles Clippers owner in the wake of racist comments attributed to him by TMZ Sports, Lester Munson of ESPN.com says the “constitution” which “governs the 30 owners of NBA teams and establishes the authority of the owners’ commissioner” proves otherwise.

“Under the terms of Paragraph 13 of the constitution, the owners can terminate another owner’s franchise with a vote of three-fourths of the NBA Board of Governors, which is composed of all 30 owners. The power to terminate is limited to things like gambling and fraud in the application for ownership, but it also includes a provision for termination when an owner “fails to fulfill” a “contractual obligation” in “such a way as to affect the [NBA] or its members adversely,” writes Munson in an article posted on Monday afternoon.

“Silver and the owners could assert that Sterling’s statements violated the constitution’s requirements to conduct business on a “reasonable” and “ethical” level.”

Munson went on to assert that “any owner or Silver can initiate the termination procedure with a written charge describing the violation,” and Donald Sterling would have five days to respond to the charges via writing.

Munson admits that to “terminate” the Los Angeles Clippers may be a last resort, but it could give the NBA a solid amount of leverage if they decide they want to oust the embattled owner in the wake of their investigation.

I don't see why it would be a "forced" sale. Same as if the dude keeled over or something. Current management can stay in place. NBA exec committee can approve budget or whatever in a way that maximizes team value.

Not sure many of know what kind of guy Sterling is, these types of guys just dont listen to anyone, they have an army of Lawyers on call. he will not sell this team. It's not about the money now. The other owners can vote whatever they want, this guy will not comply with anything they agree on.

And a ton of this is on Reinsdorf to broker this resolution. No, not formally, but if there is someone who can talk to Sterling it is him. Sterling is going to put Jerry in a place that he will need to vote against him and force him out. even then, that mess will take years.

I would say that clause is there for extreme economic affect given the language surrounding it unless you feel there is some verbal contract to not be a bad guy. Like I said, Lester is just throwing a bunch of stuff together for conversation.

Jerry has advised this guy on some big deals, they have history. I don't think anything will be easy with Tokowitz, but Jerry ahs the best shot at getting something done. It's not Reinsdorf's responsibilty either, but his roll in this helps make it the least painful for all sides.

So you wouldn't say that fucking up the playoffs, Losing team and league fanbase, Losing ticket sales for Clippers and away games, losing advertising and licensing fees on Clippers stuff, more than likely tilting the competition in the league since no one will not want to play for that franchise, getting the league painted as a league run by racists, ect. would be an extreme economic affect?

He kept the team for his own amusement.

Thats when they could have enacted some of these clauses.

That's probably why so many owners liked him. He sat on a goldmine and didn't do anything with it. Keep the status quo, don't raise expenses for everyone else. Conversely, that's why they don't like Cuban.

He didn't challenge one of the two premiere team's in the league but still captured additional west coast market. He was good for them.

The league’s decision underscores the severity and reprehensible nature of the comments attributed to Donald Sterling. These comments in no way reflect the attitude, values, and culture of the Bulls and White Sox organizations. This behavior cannot be tolerated in any form.

Discrimination and prejudice of any kind have no place in sports or in our society.

So you think its good common sense for Reinsdorf to "broker this resolution" and get himself involved with this mess even if would likely hurt his other interests? You don't think TMZ or a site like it wouldn't print a story that would end up with a headline something like "White Sox Owner Supports Sterling"? You've said yourself many times that he is a great business man. How would him brokering this resolution be a good business move?
