Why was he recording her? We don't really see what prefaced the whole thing.

Claiming someone called you name and posting a video of them online seems...wrong. I'm not too fond of this societal trend of people recording anything and everything and posting it online. I don't know what the laws are, if there are any, but just because I happen to be out and about does not mean I want -- or have given consent...does even matter? -- to be recorded by some random person and have that recording distributed online.

I like the way he left the radio on the whole time....like a soundtrack to the video. Saves the editing time later. Smart guy.
This kind of crap never happens at Dollar Tree.

From what I understand, he started his car, which scared her children. Which in turn prompted her to call him a n****r.

And she then proceeded to tell him how many cops she's stripped for.

Generally speaking, it's not illegal to record video or photograph anyone in public. States/local jurisdictions with anti-eavesdropping laws vary in terms of recording audio as well. But even in a state with anti-eavesdropping law (and I have no idea if NY has such a law or its parameters), the above video would likely be acceptable as it is being openly recorded by one party to the conversation with the knowledge of the other party to the "conversation".

Feds/states/local jurisdictions are futzing with the generally accepted legality of video-recording public spaces/people in public in recent years/in the wake of 9/11.

They look absolutely terrified in the video. Both adults seem to be really throwing them off.

This is what "The age of privacy is over" means. I believe your only real protections would be against harrassment and I don't believe they can profit off of your likeness(which is why you'll see people greyed out on television in the background). So, she may be able to sue him for a portion of the youtube proceeds he'll get.

In reality, this is far better than the alternative, which is the expectation of privacy when you are in a public space. There are countless reasons why you don't want to have that.

Maybe I'll start carrying a piece of poster board with a pixelated pattern printed on it at all times to hold up when necessary.

I'd recommend never leaving your house.

And that is the thing that bothers you the most about the video? :?

The real shame in this is that what didn't happen was she calls the cops, they show up, and they're 'blacker than the Ace of Spades' .....

From my limited understanding of how youtube works, I think Nas would get all the proceeds for the video, due to his music being the soundtrack.

Actually, I think it is if they ask not to be recorded, no matter how nasty they request it. Other than that, if you are in the public domain, yes, you are free game.

Good that he didnt stay to instigate the situation. I have been called a "WHITE MOTHER FUCKER" and I chose not to hang around and discuss the matter.
