This will be true for just about everyone. This is why you shouldn't be able to bring a doctors note so you can operate a blowtorch on crystal meth.

I got news for ya, Ike. You don't do all that well when you are sober either. Your daytime posts aren't any better.

I've been subjected to random drug testing at work 3 or 4 times since I've been working at my current job, and not once did I feel like my constitutional rights were violated.

I think that's kinda why making decisions, as well as laws, based on 'feelings' rather than objectivity are generally going to lead you down a bad path in the long run.

4th.

Are you saying taking a piss test at work is equal to an unreasonable search or seizure?

I was guessing at Bryan's response.

I dont think it is equal when it comes to work. I do think its equal when it comes to receiving government aid.

That's the part I'm interested in discussing. For what it's worth, I find the second part as absurd as many here, given the results (or lack thereof) it has produced.

And no, not all illegal search and seizures are on the same level. They remain unconstitutional on any level.

I can see why many liberal people would think it should apply to working for companies too. The libertarian in me there will always disagree. It should be completely within a company's rights to drug test it's employees, however misguided the logic behind it may be.

At the very least, I would suggest a workplace drug test is a violation of HIPAA. I'm shocked that so many people really think an employer should have so much control over them.

Are you really shocked? Hatchetman has basically stated he'd like to live under National Socialism.

Ever notice how company mgmt is always exempt? When they (who carry the most potential liability) willingly step up for testing and then public/thorough examinations of their semi-public/private lives, I'll reconsider my position against it.

I completely agree with your sentiment here, which is why I included that caveat at the end of my post. I don't think it's anything that should be commended by companies, just it shouldn't be viewed as illegal or unconstitutional IMO.

What if companies began demanding that workers have a chip implanted in them so they can be tracked at all times, is anyone in support of that? I mean, it's a great way to eliminate employees who partake in risky behavior and keep insurance premiums down for everyone else. Just call it a "Wellness Program".

I don't see any way the 4th applies in this case. Especially if you live in a state with "at will" employment law. If you don't want to work for someone who drug tests their employees, don't.

Liberty is an interesting take, but then I'd have to feel the liberty of the employee is more important than the employer.

Of course I would not support that, just like I don't support companies drug testing their employees. I would criticize anyone would willing to work for that company.

I don't really see how that improves workplace safety though.

It's really only slightly more intrusive than analyzing your piss.

I'm amazed at how many workers are willing to stand up for the rights of the corporation with some claptrap like, "If I don't like it I don't have to work there". Why not, "If an employer thinks I'm on drugs, he doesn't have to hire me" instead?

Again, I agree with this.

But I don't think we should demand privacy for employees who don't value it. Given the depressingly large number that constitutes, I can see why you would disagree, which it seems like you do.
