The agent makes money because of the client. When the client can use whatever agent they want, you shut the fuck up.

The simplest truth is that Dan is bad guy because he is not trying to appease his bosses with repeated offense behavior. This isn't the first time, he's been warned, his bosses have talked to him. Or are they too indifferent to care. Maybe they have their own agenda and despite short term poor optics they'll settle for promoting their own long term agenda. Maybe his boss will hang him out to dry with attorney's fees in some form or fashion?

But that viewpoint strikes me as a patriarchal vestige from a time past, where the man is some weak-willed victim of his own sexual desires and the woman is a predatorial hussy or homewrecker who should be forced to wear an "A" on her tunic. Second, I just don't think it's the responsibility of a single person to concern him or herself with the possible commitments of a potential lover. That's the responsibility of the person who made the commitments.
