The attorney said that he confirmed with the hospital that this was the "evidence" bag, but why would a hospital put something into an "evidence" bag? Would the authorities be the ones to put something into an "evidence" bag?

Likliest scenario: Kane's cousin and the rest of the Ice Warriors were out celebrating the DNA evidence and on a dare they broke into the police station and stole the bag (which included the girl's address)

Then they took a cab to the girl's house, dropped off the bag and ran away without paying the cabbie who can barely feed his family because of you Uber fucks

Maybe I watch too much TV but isn't the surefire way to sink any rape case is to establish a break in the chain of custody?

Outside of him being convicted, I can't think of much that would be worse than this development for Kane.

not sure what you're saying. i'd guess the chain of custody is similar to that for a urine sample for a drug test. it probably goes directly from the medical facility to the DNA testing lab. without ever being in literal police custody?

If they have already taken the evidence out of the bag, analyzed it, and logged it, does that evidence then get put in a different bag thus leaving the original evidence bag empty?

Yes, but the attorney kept using the term "evidence bag". While the hospital may have begun the chain of custody, isn't it up to the authorities, and not the hospital staff, to have an officer present to cleanly put the kit into an "evidence" bag before they take over custody? If so, why then would a nurse's initials be on an empty "evidence bag" as the attorney is claiming? I'm being serious, knowing how carefully these things are apparently handled.

We print a ton of medical forms with multiple parts - white, pink, canary paper. Each one of those pages go to different places... patient, admin, billing, physician, etc. Those forms are considered "bible" for exams, urinalysis & drug testing, etc. My point is that not everything was in that alleged bag. Multiple copies of documentation of any test or exam definitely exists elsewhere.

Aren't there two issues: a) did they have sex, and b) was it consensual? DNA would only be used to establish that they had sexual contact. If Kane is going to insist he never had sexual contact, that carries a risk because if it's somehow proven he did (even without DNA), then he can never claim consent.
