Why would they have to provide proof they have it? No one's been charged, so no one outside of LE can ask to see any evidence.

If no one is ever charged or the case doesn't go to trial/grand jury, the existence or non-existence of the rape kit/evidence bag becomes a moot point. And if someone is charged or there's a need for the evidence in a month or 6 months, "oops, we had it, now we don't. son of a gun" Or just make up a new one with some more other random DNA samples.

At this point in the proceedings and the way this case appears to be going, Erie County's in a strong position to bluff.

If she says she was gang-raped and Kane was part of it, then the DNA evidence works in her favor. If she says Kane raped her alone but she has other guys DNA in her pants, then it works against her.

Police say they were investigating an incident at Patrick Kane's home. No one has really expanded on what that incident was other than to say it was sexual assault. Was it multiple men? Just Kane? However, it would appear that no one other than Kane is being questioned as a suspect.

Even if Kane didn't actually rape her, can you agree that her leaving his house with his dna under her nails and on her shoulder and also have the dna of multiple guys inside of her makes him look bad?

The head of the crime lab and the Chief of Police really need to hold a press conferences and answer questions. They can't just release statements saying "Everything is fine" and think it's over.

Yeah. They're having fun and she's being stretched out. I can't imagine that being a good memory later in life.

From what I read yesterday, the DNA from the other men could be from men she was with weeks ago. If that's true, it doesn't necessarily mean she had sex with them at Kane's house.

DNA can be passed through sweat! It's summer, it's hot. They were in a bar. Is it reasonable to assume that if she sat next to him, he may have passed DNA through sweat, or spay (maybe he's a sprayer instead of a sayer). Under her nails? Have you ever not accidentally scratched someone? Boom...DNA transfer.

Does Julie Dicairo still think that may be rape?

he wouldn't be doing his job if he didn't. he should be asking for the case to be dropped because of the unseasonably high temps in Erie County this week. Or because the Bills lost Sunday.

Without a charge against his client, he can't do much else at this point. Once Kaner's charged, then the lawyer can ask the evidence be non-admissible due to crappy chain of custody.

Didn't the attorney say that the bag was just discovered yesterday afternoon, and the press conference was called a few hours later? In the world of legal eternities, a few hours doesn't seem to lend much credence to 'great lengths' to verify the authenticity of the bag.
