JORR and I are hanging out at the local corner tavern on a Saturday night. I'm drinking shots and pounding brews. JORR's drinking but not getting anywhere near as shit-faced as I am. JORR even helps the cause of my inebriation by buying me extra shots. Maybe while I'm in the men's room JORR slips the bartender a twenty and asks that she make my next few mixed drinks as strong as her Polish grandfather drinks em.

Last call happens and JORR and I stumble outside. I'm too drunk to drive and can't get a cab. JORR offers to sell me his bike. It's a rusted out, old style ram's horn handlebar ten speed that he got off of Craigslist for ten dollars.

Realizing I'm too drunk to parse what's happening, JORR pulls out a flask, offers me a nip and says, "Hey, tell you what, you need transportation, and I live close enough to walk home. I'll sell you my bike for $2000".

Legally speaking, I'd be able to stumble [hung over] into court Monday morning and start the process of having that sale voided due to my incapacity and intoxication.

The law protects us from ourselves in certain situations. Men and women both.

While the above scenario would be a strictly civil proceeding to void the contract, return my cash to me and JORR"s hot rod Schwinn to him; is it so implausible that maybe the law, which protects us from our own stupidity and the predatory behavior of others while drunk when it comes to our money, should also be there to protect people from compromising their bodies and long-term mental well-being by prospectively making it crime to take advantage of someone too drunk to consent to sex

I agree with NAS or whomever noted that anyone taking home the seriously shit-faced girl to fuck likely isn't inspired by even the most middling of positive intentions/emotions/thoughts.

Good thing that atty said he didn't want the case be be tried through the media.

I appreciate the question and appreciate where you're coming from. I can't really discuss too much legally at this time. Please stick to Old 97's questions.

TL:DL:

he's withdrawing as counsel for the victim. sez he was deceived about the bag found outside the vic's mother's house.

not sure, but it sounds like it's more about how the bag ended up at his office. he's not saying explicitly the bag isn't what he said it was yesterday.

he seems to be saying it's the real deal Kaner rape kit evidence bag? he turned it into the district attorney.

"manner and means" of receiving the bag.

Woah, the bag is real.

Of course. While I wish no one were getting so drunk as to pass out in the presence of horny bros or to buy rusted bikes, that doesn't make what eventually goes down any less wrong.

I haven't been following this story all that closely (read: not at all)

How was he deceived?

Is there something truly nefarious going down here that will destroy the careers and lives of certain people?

He also changed it to "one of" the evidence bags.

Before there was only one.

i'd think there would be multiple/many evidence bags. Clothes. Personal effects. I would imagine they put different samples in separate bags? I dunno for sure.

I'd expect at this point the DA to announce tomorrow morning that the investigation into any possible sexual assaults has concluded and they won't be proceeding to a grand jury or pressing charges.

And then announce an investigation into wtf went on with this evidence bag.

Long story short, it sounds like the accuser's mother pissed off her attorney and now he's withdrawing.

This is officially the shadiest event that has happened (publicly) in this whole thing.
Mom just screwed over the whole case.

It sounds like the accuser's mother's behavior is going to land her in the hoosegow. Someone's gonna have to do time for this.
You don't Peter North all over law enforcement and the judicial process and walk away with a "sorry, my bad" and a suspended sentence.

I'm not saying it does really.

But a WHOLE BUNCH of people went crazy about this evidence bag thing.

I think it kills any possibility of prosecuting Kane.

And, from a PR/what-really-happened-perspective, it favors Kane. If what the lawyer tonight said pans out, and the mom/accuser's family were reduced to dirty pool to try to make the charge stick.....the charge didn't have much ballast to begin with.
