I think there are two arguments at work here.

1. is the liability of hotel. I think the Hotel should be liable for leaking her room information. There is not 75 million dollars worth of liability though.

2. Is the detrimental effect it allegedly has had on her career. It hasn't been detrimental at all. That is easy to see. It's also difficult to make the emotional distress argument if she is perfectly willing to always put herself in the limelight. According to an article published by the North Carolina Law Review in 2010, the average wrongful death award in the United States from April 1998 to April 2008 was $3.4 million for an adult male, $3.0 million for an adult female and $5.2 million for a minor. Andrews’s demand for $75 million is not in the same ballpark as these data points

Wrongful death is considered the worst scenario of psychological distress.....thus the comparable.

More info in SI....but I dont think it looks good for her $75 mill.

and if I were Marriott, I would have given the $10 million and ran away from this as quickly as possible. There are a lot of women staying alone in Marriott hotels on business trips. Do you think this info might give them pause about the security of a Marriott?

I once was presented with a matter where big business was offering $5K on some matter. I said no. They asked what I wanted. I said $500K. I was hung up on. I had my $500K within two weeks. Sometimes you need someone to help you reassess a position you initially think is crazy.

And yeah, the Marriott should have paid this one off long ago.

I think I've told this story before but I went to south florida to visit a friend. He had a friend who is an agent to some lower end players. He brought some nondescript relief pitcher with the Marlins out with us one night and the ladies lined up for the guy. I don't know how they would have even known he was a pro athlete. Obviously they did because he wasn't a great looking guy.

Or let's say he discreetly followed her into the hotel and up to her hallway and saw that she was in room 335. If he then asked for the room next door, let's say 333 -- without mentioning her name -- would (or should) the hotel have any reason to refuse the request assuming the room was available?

I think there are scenarios where Marriot was not grossly negligent. (But I don't know what happened in this specific case.) Certainly not $75 million negligent.

Andrews was there to cover the Vanderbilt football game, and it was on campus.

She was also quite famous at the time especially for those who follow college sports.

I would assume that she uses a fake name, when checking into hotels.
