The duty isn't as high since we are talking about public property, but I do believe they have a duty to warn if there is a history of attacks or if there is a shark sighting in the area that they are aware of. I believe many beaches, if not all, do this already. A quick google search reveals many pictures of shark warning signs at countless different beaches.

I told you several times that I was making light of the bigfan situation in the what the hell is wrong with Seacrest thread but you got all things skinned and whiney about it and unknowingly did precisely what I was trying to parody bigfan about in that thread.

I saw a show during shark week that identified Daytona as one of the world's most dangerous beaches in terms of shark attacks... like top 5 iirc. I thought it was interesting cause last time I was there there was not one sign or flag or anything and it turns out was within a couple months of an attack.

I see your point on the public property thing but what bothers me is that a lot more people will be injured or killed on public property than at Disney in Florida from these types of things.

My wife's brother and I went swimming at Daytona a few days after Katrina occured... learning more about sharks that was a really dangerous time to be on the beach as for days and weeks after a hurricane sharks are much more aggressive and confused.

There is a fraction of blame to be assigned to the parents I think. I'm not a parent so I don't know exactly but I understand children can literally drown in three inches of water... so I imagine that my toddler would be in physical contact with me as he toddler in ankle deep water.
It's odd to me that a toddler would be allowed to be in a foot of water in the dark without a parent holding his or her hand or right there. The story I read said the parent jumped in after the kid... meaning there weren't right there.

This is the thing that gets me. I have been to Disney numerous times. And every time there I felt that Disney was in total control of every part of their resort. I am honestly amazed that there was an area that gators could get to where people were located. Lawyering is predominantly semantics manipulation. This is pretty simple to me, and anyone taking the side of Disney is just trolling for debate. The sign said no swimming. The sign did not say no standing in water, nor did it say there are prehistoric killing machines lurking in the water. Basically, the lack of specificity, and seemingly negligent environment will be scrutinized by the family's lawyer.

There are 1.25 million estimated alligators in Florida. I'm sure that population has only multiplied since Hachetman was skinny dipping in the lakes down there. They are a menace, but fried gator meat really does taste good.

I have no idea how close or far away the dad was but the last thing most 2 year olds will do is hold your hand near water. If I were at a Disney resort on a man made beach with no swimming signs, I could see myself being 5 ft or so away from my 3rd child that is wandering around or maybe throwing rocks/sand in the water at 9:30 at night. That does not make me a bad person or stupid. I know there are alligators in Florida. I did not know there were ones on Disney properties.

as has been covered in this thread and in the articles posted, there has recently been a change in the environment with new bungalows close to the water and guests feeding them. Article posted cited workers claiming they had warned their bosses of increasing alligator activity.

Also, just because something hasn't happened doesn't mean it won't. You don't get a get out of jail free card the first time you're negligent.
