I don't do them any more, but have performed many DuPage evictions.

First of all, DuPage is one heck of a lot more pro-landlord than Cook County, and by a landslide.

Usually you can get a court date 2-3 weeks out from filing. You cannot serve a 5 day without them missing a payment first, so you would only be suing for possession with the 30-day.

Since you don't need a money judgment, you can file for notice via publication (which will take another 2-3 weeks) if the tenant ducks Service by the Sheriff.

If the tenant does not hire an attorney, the judge may give them anywhere from 7-30 days to vacate, at which time you will file the order for eviction with the Sheriff again for "shit out on the street time".

If they lawyer-up, the process could take considerably longer. That is why, if they show up to the initial court date, you take them out in the hall and talk them into signing an agreed order to vacate after a certain amount of days. Tell them that you will not go after them for the money - works almost every time as a bargaining chip.

They blow that, and you can file immediately, as they just disregarded a court order.

Boom.

There are certainly more details and possibilities, but this is a basic outline for success.

Rule # 1: A money judgment vs. a tenant is almost as valuable as a used piece of toilet paper. i.e. forget about chasing deadbeats for money, just get possession back and chalk it up.

I 100% know that. I picked up the rent once a month. Would not give her my address, and didn't trust her to send it to a PO Box at all. She was not reliable picking it up.

Chick who served the paperwork called me the other day and said they served it. So technically she the 5 day expires the 26th, but she(renter) texted wife a couple weeks ago, she would leave on the last day. We shall see. I asked the company who serves this paperwork(they are out of Berwyn), how many times did they have to try. She told me 6-8 tries and that still is questionable. So, I have a feeling that doesn't include Dupage.
